Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Any documents referring to DG CONNECT's practice of asking requestors to narrow down information requests to 15 documents.

Specifically I am interested in any internal documents outlining the reasons and legal justifications for the specific 15 document limit, as well as communications sent within the DG about the 15 document limit.

I would be happy to clarify should you have any questions regarding my request.

01/04/2022 under reference number GESTDEM 2022/1920.

In accordance with Regulation (EC) No 1049/2001 regarding public access to

Dear Secretariat-General of the Commission,

I am filing the following confirmatory application with regards to my access to documents request with reference number GestDem 2022/1920.

In my original request, submitted on 31 March 2022 to DG CONNECT, I asked for "Any documents referring to DG CONNECT's practice of asking requestors to narrow down information requests to 15 documents. Specifically I am interested in any internal documents outlining the reasons and legal justifications for the specific 15 document limit, as well as communications sent within the DG about the 15 document limit".

On 15 July 2022 DG CONNECT replied to my request that "DG CONNECT does not hold any documents that would correspond to the description given in your application. Please note that with a view to finding a fair solution pursuant to Article 6(3) of Regulation (EC) No 1049/2001, the respective number of documents to be dealt with in the remaining timeframe take into account different factors, such as the global workload of concerned staff of DG CONNECT, the human resources available and the need to safeguard good administration."

I am asking you to review this decision, specifically taking into consideration that a search on third-party sites such as AsktheEU.org reveals that multiple requestors have received the same language from DG CONNECT, asking requestors to narrow down requests to 15 documents. While I understand what Regulation 1049/2001 says about finding fair solutions, this response has not been proportioned in relation to the size of the request since it is always the same language. (I note that during certain time-periods this number has changed to 10 documents, or 20 documents.) It therefore seems impossible that there would be no documents or decisions corresponding to the deployment of this practice, considering the frequency, coordination and implementation of this practice within the DG.
