Dear Information Society and Media (INFSO),

Please pass this on to the Secretary General who conducts Freedom of Information reviews.

I am writing to request an internal review of Information Society and Media (INFSO)'s handling of my FOI request 'Polish implementation of the re-use directive'.

On the October 3rd, 2011 I requested for access to electronic copies of whole correspondence between the Polish government and the European Commission regarding transposition of Directive No 2003/98/EC2 on the re-use of public sector information in Poland since 1st January 2005.

I was refused on the basis of exceptions provided for by Regulation 1049/2001, as the case concerning the requested documents was pending before the European Court of Justice.

I would like to draw your attention to the fact, that the judgment in case C-362/10 concerning the infringement case in question was delivered on 27 October 2011. Following delivery of the judgments, the above-mentioned exception is no longer applicable.

Therefore, as I mention in the beginning of my letter, I request you to reconsider my request.

Dear Ms Batko-Toluc,

I refer to your e-mail of 31 October 2011, registered 8 November 2011, in
which you request, pursuant to Regulation No 1049/2001 regarding public
access to European Parliament, Council and Commission documents, a review
of the position taken by the Directorate-General for Information Society
and Media on 21 October 2011, in reply to your initial request for access
of 3 October 2011.

Your application is currently being handled. Unfortunately, we have not
yet been able to finalize the reply to your application, as we need to
consult third parities whose documents are among others concerned by your
request. Since the present consultation process has not been yet
accomplished we are not in a position to reply to your confirmatory
request within the prescribed time limit which expires today.
Consequently, we have to extend this period by another 15 working days in
accordance with Article 8 § 2 of Regulation 1049/2001. The new deadline
shall expire on 20 December 2011. 

I apologize for any inconvenience this delay may cause.
