Huawei put forward to the Services of GROW.C3 some issues with the implementation of Directives on 
the Electronic Sector (LVD, EMCD, RED). In more detail: 
 
1.  On the transition between EN 62638-1:2014 and the superseded EN 60065:2014 and EN 60950-
1:2006 in the OJ list under the LVD, Huawei asked to extend the transition period until 2020. The 
Commission Services replied that this change was already planned and it would appear in the 
publication of harmonised standards of June.  
Huawei also asked for the expected date of publication of the next version of this standard. The 
Commission Services replied that this new version has not been delivered for publication, thus 
this information is with CENELEC.  
With respect to the delays in the production of harmonised standards, the Commission Services 
recalled that a similar conversation was help with Huawei last year on the same topic, but little 
improvements appear to have been implemented so far in the modernization of the 
standardization exercise. 
 
2.  Huawei asked on the legal regime applicable to spare parts. The Commission Services first 
clarified that equipment within the scope of the EU legislation, even if destined as spare part, 
shall comply with the applicable EU legislation at the moment of its placing on the market.  Then  
recalled that the Blue Guide clarifies when maintenance of equipment with spare parts may 
trigger (or not) a new conformity assessment. This requirement has to be assessed on a case-by-
case basis, according to the technical characteristics. 
 
3.  At the request of Huawei, the Commission Services described the initiatives related to three 
potential delegated acts under the RED.  
Namely these are related to: the common charger (Article 3(3)(a)), connected toys and 
smartwatches (Articles 3(3)(e and f)) and software (Articles 3(3)(i) and 4). Studies to support 
these initiatives were also announced. 
The Commission Services also asked Huawei to express their position on the MoU which they 
signed in DigitalEurope in March 2018. Huawei reserved to answer in a second moment, as the 
person in charge of this issue was not present in the meeting. 
 
4.  At the request of Huawei, the Commission Services clarified that there are currently no planned 
initiatives for a delegated act under Article 5 of the RED (registration). 


 
5.  Huawei highlighted the problem that some standards, prepared for the old LVD and EMCD, have 
not been published under the RED. At the publication of the RED-compliant versions in the 
OJEU, these harmonised standards are considered as “first publications” and consequently there 
is no allowed transition time with the old LVD and EMCD standards. 
They consequently asked the Commission Services either to delay their publications (in order to 
allow manufacturers time to adapt to the new technical specifications) or to grant a transition 
period with the old standards. 
In recalling that harmonised standard are voluntary, the Commission noted the problem but 
stressed that so far manufacturers had been asking for a prompt publication of harmonised 
standards in the OJEU. 
In any case, it was also recalled that the absence or the non-application of harmonised 
standards related to safety and EMC aspects can be overcome with a self-declaration of the 
manufacturer. 
It was also noted that at this stage it appeared that only a limited subset of harmonised 
standards are concerned by this problem (e.g. the 25 in the CENELEC’s WP). 
The Commission Services reserved to investigate this problem further. 
 
6.  On the applicability of the RED in Turkey, participants  were informed that he national draft law 
has been recently screened by the Commission services.
