1. Introduction and adoption of the agenda
The ITS coordinators explained that the draft agenda was revised prior to the meeting to address the
EDPB plenary’s request to advance the ITS ESG’s work on Guidelines 2/2020 in the context of the Art
64.2 GDPR opinion request submitted by one SA in relation to an Art 46.3(b) GDPR administrative
arrangement with the PCAOB.
The ITS ESG members adopted the agenda.
2. Update of Guidelines 2/2020
The ITS ESG members addressed the updates suggested by the rapporteurs on redress and onward
transfers / government access to data.
The ITS ESG members discussed the need to reflect the Schrems I  judgment in the guidelines and the
differences of transfers between public authorities and transfers between private entities. The co-
rapporteur agreed to examine the ful  document and make proposals in that sense taking inspiration
from the work of the Schrems I  taskforce on supplementary measures for transfers between private
entities, while taking into account the specificities of transfers between public authorities.
The ITS ESG members exchanged on one SA’s suggestion to add some wording at the end of paragraph
38. Furthermore, they welcomed the new paragraph 43a on onward transfers.
In relation to redress, one SA suggested some changes that wil  be included by the rapporteur.
The  ITS  ESG  members  were  invited  to  share  any comments by  29  September  2020,  and  were
informed  that  in  case  no  comments  are  received,  the drafting  team  working on  PCAOB
arrangements wil  use this as a basis for the meeting with the CEAOB and PCAOB planned on 1
October 2020.
