Your confirmatory application for access to documents under Regulation
(EC) No 1049/2001 – GESTDEM 2022/2286
Dear Ms Kieninger,
I refer to your e-mail of 4 October 2022, registered on the following day, in which you
submitted confirmatory application in accordance with Article 7(4) of Regulation (EC) No
1049/2001 regarding public access to European Parliament, Council and Commission
documents1 (hereinafter ‘Regulation (EC) No 1049/2001’).
Your confirmatory application was submitted in relation to your initial application of
20 April 2022, in which you requested access to, I quote:
‘
1- all correspondence (including email, SMS, private twitter and WhatsApp)
since 1st February 2022 between Commissioner Simson, and/or her cabinet
and/or officials from DG Energy with representatives from the oil and gas
industry, namely in which the EU’s response to Ukraine invasion, particularly
the RePowerEU communication was discussed.
2- any briefings prepared for Commissioner Simson, and/or her cabinet and/or
officials from DG Energy for meetings since 1st February 2022 with
representatives from the oil and gas industry, namely the following associations:
Eurogas, GIE, Gas4Climate, IOGP, Marcogaz, FuelsEurope and GasNaturally in
which the EU’s response to Ukraine invasion, particularly the RePowerEU
communication was discussed.

3 - list of meetings since since since 1st February 2022 between Commissioner

and/or her cabinet and/or officials from DG Energy with representatives from the

Gas4Climate, IOGP, Marcogaz, FuelsEurope and GasNaturally in which the
EU’s response to Ukraine invasion, particularly the RePowerEU communication
was discussed.’
The processing of your initial application was assigned to the Directorate-General for Energy
of the Commission. As you did not receive an initial reply within the statutory time limits,
you submitted a confirmatory application on 4 October 2022.
In the meantime, a reply to your initial application was sent to you on 24 January 2023 by the
Directorate-General for Energy
Against this background, the Secretariat-General will close your confirmatory application
related to the lack of initial reply.
You remain entitled to submit new confirmatory applications in accordance with Article 7(2)
of Regulation (EC) No 1049/2001, should you wish to request a review of the initial reply of
24 January 2023.
