Dear Mr Sabido,
I refer to your e-mail of 23 November 2022, registered on 24 November 2022, by which
you submit a confirmatory application in accordance with Article 7(4) of Regulation
(EC) No 1049/2001 regarding public access to European Parliament, Council and
Commission documents1 (hereafter ‘Regulation (EC) No 1049/2001’).
Your confirmatory application was submitted in relation to your initial application of
11 April 2022 in which you requested, I quote:
1. ‘All correspondence (including email, SMS, private twitter and WhatsApp)
since 1st February 2022 between Commissioner Simson, and/or her cabinet
and/or officials from DG Energy with representatives from Wintershall,
Uniper Fortum, OMV, RWE, TotalEnergies, ExxonMobil, Shell, BP, Eni,
Repsol, Galp in which the EU’s response to Ukraine invasion, particularly
the rePower communication was discussed.
2. Any briefings prepared for Commissioner Simson, and/or her cabinet
and/or officials from DG Energy for meetings since 1st February 2022 with
representatives from Wintershall, Uniper Fortum, OMV, RWE,
TotalEnergies, ExxonMobil, Shell, BP, Eni, Repsol, Galp in which the EU’s

response to Ukraine invasion, particularly the rePower communication was
discussed.
3. List of meetings since since since 1st February 2022 between with
representatives from Wintershall, Uniper Fortum, OMV, RWE,
TotalEnergies, ExxonMobil, Shell, BP, Eni, Repsol, Galp in which the EU’s
response to Ukraine invasion, particularly the rePower communication was
discussed.
4. Minutes of the meetings mentioned above.’
The initial request was assigned to the Directorate-General for Energy. As you did not
receive an initial reply from that Directorate-General within the statutory time limits, you
submitted a confirmatory application on 23 November 2022.
In the meantime, the initial reply in question was sent to you on 03 January 2023
(registered under reference number Ares(2023)13627).
Against this background, the Secretariat-General will close your confirmatory application
related to the lack of initial reply.
You remain entitled to submit a new confirmatory application in accordance with Article
7(2) of Regulation (EC) No 1049/2001, should you wish to request a review of the initial
reply of 03 January 2023.
