I  refer  to  your  e-mail  of  15 November 2022,  registered  on  the  same  date,  in  which  you 
submit 

confirmatory

Article 7(4)

Regulation (EC) No 1049/2001 regarding public access to European Parliament, Council 
and Commission documents1 (hereafter ‘Regulation (EC) No 1049/2001’).  
Your  confirmatory  application  was  submitted  in  relation  to  your  initial  application  of 
24 August 2022,  as  clarified  by  your  email  of  29 September 2022,  whereby  you 
requested access to the following documents:

1) All correspondence (including emails and WhatsApp messages) between the European 
Commission  Migration  and  Home  Affairs  and  the  International  Centre  for  Migration 
Policy Development (ICMPD) since 02/03/2016

Whereas the Directorate-General for Migration and Home Affairs had sent you its initial 
reply  on  14 October 2022,  it  did  not  reach  you  due  to  a  technical  issue,  for  which  we 
would like, hereby, to apologise. 
In the meantime, the Directorate-General for Migration and Home Affairs sent you again 
its initial reply on 22 November 2022 (under reference number Ares(2022)7130340).  
Against this background, the Secretariat-General will close your confirmatory application 
related to the lack of initial reply in respect to your request. 
You  remain  entitled  to  submit  a  new  confirmatory  application  in  accordance  with 
Article 7(2)  of  Regulation (EC) No 1049/2001,  should  you  wish  to  request  a  review  of 
the initial reply of 22 November 2022.
