Dear Ms Cann, 
We  refer  to  your  e-mail  dated  21/04/2015  in  which  you  ask  for  further  information 
related  to  your  request  for  access  to  documents,  registered  on  03/02/2015  under  the 
above mentioned reference number. We have replied to your application and sent you the 
available documents on 20/04/2015. 
In  your  e-mail  you  specifically  ask  for  a  clarification  on  how  Commissioner  Kroes 
replied to the 2013 invitation to attend a lunch. 
We  regret  to  inform  you  that  no  documents  were  found  that  would  correspond  to  your 
question.  You  have  already  received  all  the  documents  available  concerning  exchanges 
between  Commissioner  Kroes  and  the  Bank  of  America  Merrill  Lynch  since  1  January 
2013.  
Indeed,  as  specified  in  Article  2(3)  of  Regulation  1049/2001,  the  right  of  access  as 
defined  in  that  regulation  applies  only  to  existing  documents  in  the  possession  of  the 
institution.  
 
Given that no such documents have been identified, the Commission is not in a position 
to handle your request.
