Thank you for your email. I can indeed confirm that discriminatory JV requirements are 
part of the negotiations. We have not discussed specific sectors yet, but expect to do so 
later within 2016.

I hope this email finds you well.  
 
I refer to our various exchanges on the EU-China Investment Agreement, both 
bilaterally as well as in the framework of BusinessEurope meetings. 
 
As we have discussed during those occasions, ACEA fully supports the 
intensification of investment relations between the EU and China and has been 
advocating for an ambitious and comprehensive Investment Agreement with a 
strong coverage of investment market access as well. As the joint venture 
requirement in China with an equity cap of 50% 
Art. 4.2 first indent 
 
 
, we have appreciated that the Commission has 
intended to put an emphasis on discussing such restrictions with China in the 
Investment Agreement.   
 
We have taken good note of the Commission’s statement released on 15 January 
with regard to the agreement reached with China on the scope of the agreement. 
We were wondering if you could inform us in more details about the coverage. We 
would particularly appreciate your confirmation whether such important joint 
venture requirements for non-services (in our case automobile manufacturing) 
will be in the scope of the negotiations going forward.
