Dear Mr. Demarty,
First of all I would like to thank you for participating today at the International Relations
Committee meeting of BUSINESSEUROPE. As usual we had a very interesting exchange.
As I have anticipated to you I am enclosing BUSINESSEUROPE’s assessment of the European
Commission’s proposal on a new Investment Court System. This is the outcome of intensive
discussions BUSINESSEUROPE had with members.
I am well aware of the difficult balance the Commission had to make in its proposal. From the
start we have always recognised the need to modernise ISDS but we believe that the proposal
currently on the table does not guarantee a sufficient level of protection for our companies
when they are investing in Third Countries.
We are of course open to discuss further with you and your services.
