Dear Mr  Cox, 
We  understand that  the  Conference  of  Presidents  will  take  a  decision  on  13 June  to  settle  the 
conflict of competencies  between  the  Legal Affairs  Committee and the Environment  Committee 
on  the proposal for  a  directive  on  environmental  liability  (COM(2002)0017 final).  This  will 
follow the  unanimous decision  on  16th May  by  the three  vice-presidents  in  charge of conflict of 
competencies to  reallocate  the proposal to  the Environment Committee. 
Since  then.  Mrs  Ana  Palacio  Vallerlersundi;  as  Chairman  of  the  Conference  of  Committee 
Chairmen,  has  asked  Mr  Gargani,  as  Chairman  of  the  Legal  Affairs  Commitee  and  Mrs 
Jackson.'  as  Chairman  of  the  Environment  Committee,  to  provide further  arguments for  the 
meeting  of  the  Conference  of  Presidents.  Our  understanding  of  the  rules  of procedures  is  that 
the  Chairman  of  the  Conference  of  Committee  Chairmen  should play  a  role  of  mediator super 
partes  in  the first phase  of  the  conflict,  but should  not  interfere  in  the following  steps  of  the 
procedure. 
We  would lilce  to  underline  the fact  that  the final decision  has  to  be  taken  by  the  Conference  of 
Presidents;  so far  it  always followed the  opinion  of  the  three  vice-presidents  also  because  the 
procedure for  the  examination  of  the  question  is  accurate  and detailed.  In  order  to  keep  the 
credibility  of  the  whole  internal  dispute  settlement  mechanism for future  conflicts,  our group 
would  therefore  like  to  see  the  proposal  of  the  three  vice-presidents  endorsed  as  quickly  as 
possible  to  allow  the  European  Parliament  to  give  its  opinion  on  this  important  piece  of 
legislation.
