Request  for  clarification  in  regards  to  your  application  for  access  to 
documents, Ref. GestDem N° 2018/1904
 
 
Dear Ms Eberhardt,  
We  refer  to  your  letter  dated  29  March  2018  in  which  you  make  a  request  for  access  to 
documents, registered on the same day under the above mentioned reference number. 
You requested access to the following:  
"[…] 
–  all reports (and other notes) from meetings between Martin Selmayr (now Secretary 
General, before Head of Cabinet of Commission President Jean-Claude Juncker) and 
representatives of the car industry (so representatives of individual companies and car 
industry federations), since 1 January 2017; 

–  all correspondence (including emails) between Martin Selmayr and representatives of 
the car industry since 1 January 2017; 
–  all reports (and other notes) from meetings between Martin Selmayr and the German 
Ministry  of  Transport  and  Digital  Infrastructure  (including  its  former  Minister, 
Alexander Dobrindt), since 1 January 2017; 

–  all  correspondence  (including  emails)  between  Martin  Selmayr  and  the  German 
Ministry  of  Transport  and  Digital  Infrastructure  (including  its  former  Minister, 
Alexander Dobrindt), since 1 January 2017.

You  also  introduce  a  request  under  the  Code  of  Good  Administrative  Behaviour,  namely 
"[…]a    list  of  all  the  above-mentioned  documents  (including  dates,  names  of    participants/ 
senders/ recipients and their affiliation, subject of meeting/correspondence
) "[…]. As this part 
of your request is not based on Regulation 1049/2001, it will not be addressed in the context of 
your request registered under reference number GestDem N°  2018/1904.

The  description  given  in  your  application  does  not  enable  us  to  identify  documents  which 
would correspond to your request. In particular, the term representatives of the car industry (so 
representatives  of  individual  companies  and  car  industry  federations)  
does  not  allow  the 
Commission services to perform the necessary search for documents falling within the scope of 
your request.  
We therefore invite you, pursuant to Article 6(2) of Regulation (EC) No 1049/2001 regarding 
public access to documents, to provide us with detailed information on the type of documents 
which  you  seek  to  obtain,  for  example  by  listing  concretely  the  representatives  of  the  car 
industry (representatives of individual companies and car industry federations) you refer to.  
We  also  invite  you  to  specify  the  subject matter  of  the  reports/correspondence  to  which  you 
request access, and define the concrete dates/periods during which the documents would have 
been produced and persons or bodies who drafted the documents. 
The 15 working days the time limit for handling your application will start running when we 
receive the requested clarifications.
