Preparation for the trilogue
I.
INTRODUCTION
1.
On 8 November 2017 the Commission submitted a proposal for a Regulation on setting new
CO2 emission standards for cars and vans. The aim of the proposal is inter alia to contribute to
reaching the 30% reduction target by 2030 in the non-ETS sectors set by the European
Council, as translated into the national targets in the Effort Sharing Regulation, and to
achieving the objectives of the Paris Agreement.

The Economic and Social Committee delivered its opinion on 14 February 2018.
The Committee of the Regions decided not to give an opinion.

In the European Parliament, Ms. Miriam DALLI (S&D, MT) was appointed as rapporteur for
the proposal on behalf of the ENVI Committee. On 3 October 2018, the Parliament adopted
71 amendments to the proposal.

On 9 October 2018, the Council reached a general approach

Two trilogues took place on 10 October and 13 November 2018 respectively.
6.
Following the second trilogue and work at technical level, a number of issues, including
relating to Council text, have been agreed or tentatively agreed as indicated in the fourth
column of the table contained in Annex I to this note.
7.
Technical work has continued with the Parliament and the Commission in order to make
further progress, resulting in draft text on a number of issues in preparation of the third
trilogue scheduled for 4 December 2018.
8.
The aim of the third trilogue is to achieve agreement on all outstanding issues.
II. PRESIDENCY SUGGESTIONS IN VIEW OF THE TRILOGUE
9.
On notably the following issues, the Presidency proposes text based on work undertaken at
technical level in order to further accommodate the Parliament but under the understanding
that the Parliament reciprocates this flexibility:
a)
Real-Drive Emission test (Amendments 44, 47, 48, 49, 50, 51, 54 and 22 (part). The
Presidency suggests as compromise the following package of additions aimed at
addressing the issue of Real-Drive Emissions:
i)
A new paragraph 2 in the review clause (Article 14) mandating the Commission to
assess the feasibility of developing real-world emission test procedures using
portable emission measurement systems (PEMS);
ii)
A mandate to the Commission to assess how the data on fuel and energy
consumption from the on board monitoring devices may be used to ensure
continued representativeness of the values determined in accordance with the
WLTP test procedure (Article 12 (2b) (new)).

b)
As concerns the issue of Lifecycle analysis (Amendments 40 and 23), the Presidency
suggests as a compromise a text based on elements from the Parliament amendments,
whereby the Commission in the 2023 review should evaluate the possibility of
developing a common Union methodology for the assessment and the consistent data
reporting of the full life-cycle CO2 emissions.
c)
On car labelling (Amendments 55 and 9), the Presidency suggests a more simplified text
based on the Parliament's amendments. The Parliament can now agree to
31 December 2020 as deadline for the review and the Presidency suggests agreeing
to that.
d)
On the long term ambition (Amendment 1, recital 3), the Presidency suggests text for a
new recital 2a and a revised recital 3 which refers to the recent IPCC report and in order
to further accommodate the Parliament, refers to "In order to contribute to the Paris
Agreement objectives, the transformation of the entire transport sector towards zero
emissions needs to be accelerated". These recitals incorporate the previous Council
recital 6a in its entirety.
e)
On the issue of WLTP measured, the Presidency suggests to accommodate the
Parliament's wish for further clarifications as provided by the Commission and
consequently accept the amendments to the Council text as set out in Annex II to this
note.
f)
As concerns the verification of in-service conformity testing and the question of the
procedure for adopting the procedures related thereto, options have been examined at
technical level. In order to address the concerns raised by the Parliament and to find a
solution, the Presidency suggests in a spirit of compromise but only as part of a final
agreement to:
i)
Incorporate the in-service conformity testing as a self-standing Article (12a) into
this Regulation together with provisions on the issue of “defeat devices”;
ii)
Maintain the implementing acts for the adoption of the procedures, however,
basing these on guiding principles and criteria to be adopted by delegated acts.

In addition, on some other issues where the Parliament has called for additional text, the
Presidency suggests to accommodate this. This concerns in particular the new
recital 10b (enabling framework) covering Amendments 4, 12 and 16 and a recital on
reference mass (Amendments 30, 31 and 18) in addition to Article 2 (1). On the latter it
is also suggested to accommodate the Parliament's wish not to limit the provision to N1
vehicles. An Article addressing the issue of defeat devices in addition to the recital
already agreed is also proposed to be included in Article 17 (see above under f)).
10. As concerns "Just transition - earmarking" (Amendments AM 3, 21 and 41), discussions have
continued on the basis of the Presidency's mandate to further explore the issue. However, so
far no workable or legally or budgetary sound solution has been found.
11. In relation to eco-innovations, the Presidency has made a compromise suggestion as regards
the adjustment of the cap that addresses the Parliaments concerns that the credits for eco-
innovations remain proportional to the average of manufacturer’s specific emissions.
12. The Presidency proposes to maintain the prolongation of the niche derogation but as a step
towards the Parliament to reduce the threshold for when the derogation can be applied to
270.000 newly registered vehicles per calendar year.
13. As regards, the scheme to incentivise sales of low- and zero emission vehicles into Member
States with low market penetration of these vehicles, the Presidency suggests that the
Commission in the context of the review assess the appropriateness of the level of the
multiplier in light of the potential effects of the scheme.

fourth column of the table contained
in Annex I and the text set out in Annex II to this note.
III. KEY ELEMTS - LEVEL OF AMBITION
15. As concerns the key elements pertaining to the level of ambition, i.e. targets and ZLEV
incentives, both the Parliament and the Council will have to show flexibility in order to reach
a final compromise.

In this context, it is recalled that the positions of the Parliament and the Council differ
considerably:
–
the Parliament is calling for higher targets for 2025 and 2030 for both cars and vans and
cannot accept a differentiation between cars and vans,
–
on the ZLEV incentives mechanism, the Parliament wishes to introduce higher
benchmark levels and proposes to introduce a two-way incentive system (“bonus-
malus”) and conversely cannot accept the two specific incentive schemes introduced by
the Council;
–
the Parliament cannot agree to a prolongation of the niche derogation;
16. Bearing in mind the careful balance of the Council position carried by a broad majority and
with a view to determining the margin of manoeuvre on the key elements for being able to
reach an agreement at the next trilogue, the Presidency would like to invite delegations to
share their views on the following questions:
1)
Which of the key elements mentioned above could be included in a final compromise?
2)
What range of flexibility do delegations have with regard to these key elements?
IV. CONCLUSION
In view of the upcoming trilogue, the Permanent Representatives Committee is invited to agree to
the Presidency's suggestions as set out in Annex I (the four-column table) and II to this note and to
provide the Presidency with their views on the questions set out above.
