2. Minutes of last meeting
Minutes of 26 June subgroup meeting were adopted.
3. EDPB Guidelines under Art. 51 LED
The subgroup discussed the memo on the tasks of the EDPB under the Law Enforcement
Directive as referred to in article 51.1 c) to e). The interpretation of those provisions, as
suggested in the memo, was agreed.
Taking into account the fact that several MS still did not implement the LED yet, the document
from EDPB could influence the legislative process, including shaping the powers of SAs.
Coordinator asked whether members could volunteer as rapporteurs on these topics at the
Members discussed as well the practical experience with the data breach notifications from
law enforcement agencies.
To do: delegations will inform the coordinator and the Secretariat if they wish to become the
4. Future of supervision models for EU large IT systems in the JHA area (
The subgroup discussed the draft document presented by the rapporteurs. There was a
general support for the proposed model of the supervision. The rapporteurs will continue to
analyse the problem of the membership and the appropriate autonomy towards the EDPB.

to be presented at the next Plenary.
5. EU proposals on e-evidence
The BTLE subgroup discussed the draft position paper on the proposal for a regulation and a
directive regarding the “e-evidence package”. The group supported the position proposed by
the rapporteurs. The draft will be finalised with the changes proposed by the members,
mainly in the part on necessity.
To do: new version of document with accompanying info note will be sent to the Secretariat
on 13 September to be adopted by the next Plenary.

7. Privacy Shield
The second joint review of the Privacy Shield will take place on 18-19 October 2018. The first
preparatory meeting of the review team took place.
9. Any other business
- The next meetings will take place on, 18 December 2018, 19 February 2019, 16 April 2019
and 18 June 2019;
- COM published Japan adequacy decision and plan to ask the EDPB for its opinion soon, most
probably the deadline will be 6-8 weeks and BTLE will work with ITS on this issue;
- EDPS and FR represented the EDPB in the Octopus Conference. The main focus was on the
amendment of the Cybercrime Convention. More data protection oriented meeting will be
held in November and EDPB contribution will be needed.
