We refer to your communication dated 2/07/2020 in which you made a request for access to
documents, registered under the above-mentioned reference number.
You will find enclosed all documentation, including but not limited to attendance lists,
agendas, background papers, minutes/notes and email correspondence about or summarising
the following meetings:
- meeting between members of the cabinet of President Ursula von der Leyen and the
European Steel Association (EUROFER) regarding the Emissions Trading System
indirect costs and state aid on 26/05/20
- meeting between members of the cabinet of Executive Vice-President Valdis
Dombrovskis and Verband der Chemischen Industrie e.V.(VCI) regarding the
European Green Deal and recovery on 06/04/20
Please note that some of the documents contain personal data that has been redacted
according to the General Data Protection Regulation (Regulation (EU) 2018/17251) and to the
internal rules of procedure of the Commission. As your request does not express any particular
interest to have access to these personal data, and does not establish the necessity to have the data
transmitted, I conclude that access cannot be granted to these personal data.

In case you would disagree with this position, you are entitled, in accordance with Article 7(2) of
Regulation (EC) No 1049/2001, to submit a confirmatory application requesting the Commission
to review this position.
Your request also encompassed a meeting between members of the cabinet of President
Ursula von der Leyen and Cerame-Unie regarding the EU Emissions Trading System on
13/05/20 and a meeting between members of the cabinet of Executive Vice-President Frans
Timmermans and Air Liquide regarding the Clean Hydrogen Alliance on 26/05/20.
Upon reviewing the documents related to these two meetings, it emerged that some of them
are authored by third parties. As regards third-party documents, Article 4, paragraph 4 of
Regulation (EC) No 1049/2001 provides that ‘the institution shall consult the third party with
a view to assessing whether an exception in paragraph 1 or 2 is applicable, unless it is clear
that the document shall or shall not be disclosed’. In both these cases, it was determined that
the third parties involved should be consulted regarding disclosure of these documents. You
will receive the documents which can be shared, partly or fully, once the third parties have
had an opportunity to express their preference and rationale regarding the sharing of these
documents.
You should send any such confirmatory application within 15 working days of receipt of this
letter to the Secretary-General of the Commission at the following address:
