Your confirmatory application for access to documents under
Regulation (EC) No 1049/2001 - GESTDEM 2021/4854
Dear Mr Civillini,
I refer to your e-mail of 3 June 2021, registered on 4 August 2021, in which you submit a
confirmatory application in accordance with Article 7(4) of Regulation (EC) No
1049/2001 regarding public access to European Parliament, Council and Commission
documents1 (hereafter ‘Regulation (EC) No 1049/2001’).
Your confirmatory application was submitted in relation to your initial application of
21 April 2021 in which you requested, I quote:
‘For the period between 1 January 2019 to date:
- a list of all lobby and industry meetings and/or calls held by the DG ENV, including
any Cabinet Members and/or officials, during which “deep-sea mining” and/or “seabed
mining” and/or “marine minerals” were discussed.
The list should include: date, individuals attending and organisational affiliation, as well
as the issues discussed;
- all minutes and other reports of these meetings and/or calls;

- all documents prepared for the purpose of the meetings and/or exchanged during the
course of the meetings.
- all correspondence, including attachments (i.e. any emails, mail correspondence or
telephone call notes) between the DG ENV, including any Cabinet Members and/or
officials, and any lobby group and/or industry representative discussing “deep-sea
mining” and/or “seabed mining” and/or “marine minerals”;’
The initial request was assigned to the Directorate-General for Environment. As you did
not receive an initial reply from that Directorate-General within the statutory time limits,
you submitted a confirmatory application on 3 June 2021.
In the meantime, the initial reply in question was sent to you on 15 September 2021
(under reference number Ares(2021)5652371).
Against this background, the Secretariat-General will close your confirmatory application
related to the lack of initial reply.
You remain entitled to submit a new confirmatory application in accordance with Article
7(2) of Regulation (EC) No 1049/2001, should you wish to request a review of the initial
reply of 15 September 2021.
