Regulation (EC) No 1049/2001 - GESTDEM 2021/3003 

Dear Ms Balanya,  
I refer to your e-mail of 8 July 2021, registered on 12 July 2021, in which you submit a 
confirmatory  application  in  accordance  with  Article 7(4)  of  Regulation  (EC)  No 
1049/2001  regarding  public  access  to  European  Parliament,  Council  and  Commission 
documents1 (hereafter ‘Regulation (EC) No 1049/2001’).  
Your  confirmatory  application  was  submitted  in  relation  to  your  initial  application  of  
6 May 2021 in which you requested, I quote: 
‘1  -  all  correspondence  (including  email)  between  1st  january  2021  and  6th  May  2021 
between  Commissioner  Simson,  Commissioner  Timmermans,  Commissioner  Breton, 
President  van  der  Leyen,  Commissioner  Dombrovskis,  and/or  their  cabinets  and/or 
officials from DG Energy, DG Clima, DG Grow, DG Trade and Secretariat General on 
one hand and stakeholders on the other, where the issue of the carbon border adjustment 
mechanism is addressed. 
2  -  list  of  meetings/videocalls/calls  between  1st  December  2020  and  6th  May  2021 
between  officials  and/or  representatives  of  the  European  Commission  and  stakeholders 
where the issue of the carbon border adjustment mechanism is addressed.

The  initial  request  was  assigned  to  the  Directorate-General  for  Trade.  As  you  did  not 
receive an initial reply from that Directorate-General within the statutory time limits, you 
submitted a confirmatory application on 8 July 2021. 
In  the  meantime,  the  initial  reply  in  question  was  sent  to  you  on  16  July  2021.  In  its 
reply, the Directorate-General for Trade identified 14 documents and provided you with a 
list of these documents. It partially disclosed these documents based on the exception laid 
down  in  Article  4(1)(b)  (protection  of  privacy  and  the  integrity  of  the  individual)  of 
Regulation (EC) No 1049/2001.  
Against this background, the Secretariat-General will close your confirmatory application 
related to the lack of initial reply. 
You remain entitled to submit a new confirmatory application in accordance with Article 
7(2) of Regulation (EC) No 1049/2001, should you wish to request a review of the initial 
reply of 16 July 2021.
