Dear PAD,
In regards to my request, the European Border and Coast Guard Agency requested that I narrow down my request so that they could focus on Serious Incident Reports that would best suit my needs, because the amount of documents for the period starting in 2014 is quite extensive.

Is it possible to narrow the request by asking for only those Serious Incident Reports for JO Triton that include references to commercial ships, in 2014.

Considering the different references to commercial ships this request would also include mention of any reference to merchant ships, , MV, M/V, mv, m/v, or specific merchant ship name.

Dear PAD,
The quick replies are very much appreciated. I was hoping to get some clarification with respect to the information I’ve received. I was asked to “narrow” my initial request for all Serious Incident Reports filed during JO Triton because this would have resulted in an “extensive” amount of documents. I subsequently narrowed my request to only those SIR’s that include references to merchant ships, in any of the following three categories, 1) reporting unit/person, 2) original informant, 3) fact of the case. The final response to this request included only 12 SIR’s.

After reviewing the available JORA data for JO Triton I noticed that 1) the term “commercial” is employed more frequently than the term “merchant”, and 2) there were far more than 12 incidents involving commercial ships. In an effort to attain more of the SIR’s filed during JO Triton that involve merchant and/or commercial ships and/or vessels, I decided to make another request for SIR’s involving “commercial” ships instead of “merchant” ships—like my initial request.

The January 18th response seemed contradictory: in the first paragraph it asked me to narrow my request, and in the second it stated that my request would be forwarded to the responsible Unit. Despite not narrowing my request, a January 22nd response stated that Frontex would grant me access, however the reply only included one SIR.

While I was excited that Frontex had granted my request, I was surprised to only receive one additional SIR. To attain more SIR’s involving commercial ships during JO Triton, I responded to the request to narrow my search, but this time I chose to narrow the request to include only those JO Triton SIR’s referencing commercial ships in 2014. In retrospect, I should have acknowledged the discrepancy between Frontex approval of my request and the single SRI. Instead I thought it might yield more results if I responded to the initial request to narrow the search. I thought it might be more manageable to provide SRI’s by year, so I started with 2014.

I apologize for the confusion. If you could please advise me how to request and receive all Serious Incident Reports involving commercial ships during JO Triton that would be very much appreciated. I understand that this is quite an extensive request, and if making separate requests for 2014, 2015, 2016 and 2017 is more manageable, I can proceed in this way. Also, if you would like me to specify categories/variables under which references to commercial or merchant ships are made (in addition to year) I can narrow the parameters of my request in this way too.

In regard to your request for "a copy of all serious incident reports involving commercial ships during Joint Operation Triton", we had initially assumed that a great extent of SIRs containing the keyword “commercial ships" would exist, of which possibly not all would have suited your needs but would have nevertheless required a careful analysis from our side. Consequently, we had asked you in our email of 15 January 2018 to narrow down your request to better serve you but started in parallel our research for your document(s). By 22 January 2018, it was established that only one SIR pertaining to your request existed. As we had not received a response from you by this date and since a narrowing down was not seen as necessary, we had sent you this document on 22 January 2018.
