Access to documents data

Ihre Anfrage war teilweise erfolgreich.

Dear European Agency for the operational management of large-scale IT systems in the area of freedom, security and justice,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

All data on the handling of access to documents requests by the eu-LISA for the years 2012-2017, both inclusive. If the data for the year 2017 is currently being processed and is therefore not yet ready for publication, then the data for the years 2012-2016 should do.

I am looking specifically for broken down data, per year, on:
- number of initial access to documents applications and types of outcome (full access, partial access, refusal, etc);
- number of confirmatory applications and types of outcome;
- number of complaints to the European Ombudsman on the eu-LISA's application of Regulation 1049/2001;
- number of cases brought before the EU Courts on the eu-LISA's application of the Regulation;
- application of the exceptions laid out in Article 4 of the Regulation in case of partial access or refusal;
- documents most frequently requested; and
- application of deadline extensions.

Please do not hesitate to contact me if you need any clarification in regards to any aspect of my request.

Thank you in advance.

Yours faithfully,

Luisa Izuzquiza

Dear Madam,

The Agency wants to meet the requests of EU citizens asking to access public documents. However, the essential condition to grant access to documents is that the requested document exists.

The Agency does not hold such a document as the one you requested in your application acknowledged by eu-LISA on 31 January 2018.

Can you therefore be more precise in identifying the document you wish to access?

Regards,

EULISA INFO

Dear eu-LISA,

Thank you for your response. I am afraid I will not be able to precisely identify the document I wish to access as I do not know what documents eu-LISA holds.

Nonetheless, I can give you a couple of examples of the kinds of documents I have in mind, which contain the information I requested initially:
- the European Commission's annual report on access to documents and its annexes (see example of the report here, for 2016: http://eur-lex.europa.eu/legal-content/e... )
- Frontex annual report on access to documents, contained in annex 2 of its Annual Activity Report (see example for 2016 here: frontex.europa.eu/assets/About_Frontex/Governance_documents/Annual_report/2016/Annual_Activity_Report_2016.pdf )

These two documents contain, in line with my initial request, "All data on the handling of access to documents requests" by these two EU bodies.

I am interested in any documents held by eu-LISA which contain such an analysis of access to documents requests received by the agency since 2012 to 2017, both inclusive.

I recall that this is, in particular, the data I'm interested in:
- number of initial access to documents applications and types of outcome (full access, partial access, refusal, etc);
- number of confirmatory applications and types of outcome;
- number of complaints to the European Ombudsman on the eu-LISA's application of Regulation 1049/2001;
- number of cases brought before the EU Courts on the eu-LISA's application of the Regulation;
- application of the exceptions laid out in Article 4 of the Regulation in case of partial access or refusal;
- documents most frequently requested; and
- application of deadline extensions.

Hopefully this will have made my initial application clearer. Please do not hesitate to let me know if you would have any further doubts or questions.

Yours sincerely,

Luisa Izuzquiza

Dear eu-LISA,

Many thanks for your response. The data provided is indeed very useful.

I was wondering if eu-LISA is in possession of, and would be able to provide, further details on the application of exeptions laid out in Article 4 of Reg 1049/2001 for the year 2016.

To give an example, I would be looking for details such as the ones that can be found in the EEAS report on access to documents for 2013 (see here:https://www.asktheeu.org/en/request/5103... in page 3). If this level of detail is not possible, an estimation of which exceptions under Article 4 are most frequently applied would be also very welcome.

Many thanks in advance!

Yours sincerely,

Luisa Izuzquiza
