Dear International Partnerships,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents concerning African Parks and its operations, held by DG International Partnerships since 1 January 2005, which contain the following information:
1. A list of meetings of DG International Partnerships officials and/or representatives (including the Commissioner and the Cabinet) concerning African Parks and its operations.
2. Minutes and other reports of these meetings
3. All correspondence (including e-mails) between DG International Partnerships officials and/or representatives (including the Commissioner and the Cabinet) and other European institutions/departments concerning African Parks and its operations.
4. All correspondence (including e-mails) between DG International Partnerships officials and/or representatives and/or representatives (including the Commissioner and the Cabinet) and third parties/individuals concerning African Parks and its operations.
5. All documentation concerning EU-funding of African Parks and its operations.
We extend our request to other parks managed by APN that have received EU funding and/or to parks where the EU has funded preliminary studies with the intention of an agreement between a national government and APN, regardless whether the agreement has finally been signed or not. Why do we need your personal postal address?
Since 1 April 2014, the submission of a postal address became a mandatory
feature when submitting an application for access to Commission documents
via an e-mail. We would like to explain why we need your postal address in
order to register and handle your application for access to documents when
submitted via e-mail:
• Firstly, to obtain legal certainty as regards the date you received
the European Commission reply to your application for public access to
documents. Article 297 of the Treaty on the Functioning of the
European Union (TFEU) states that 'decisions which specify to whom
they are addressed, shall be notified to those to whom they are
addressed and shall take effect upon such notification.' In line with
this provision, if the Commission does not grant full access to the
requested documents, it notifies the reply to the applicant via
registered mail with acknowledgement of receipt or via delivery
service. This requires an indication of a valid postal address by the
applicant;
• Secondly, to apply correctly the [2]Data Protection Regulation (EU)
2018/1725. Knowing whether the applicant is an EU resident (or not) is
necessary for deciding which conditions shall apply for the
transmissions of personal data to applicants for access to documents.
These conditions are not the same for recipients established in the
Union and for recipients in third countries. As the vast majority of
the documents requested contain personal data, the Commission cannot
ensure the correct application of the data protection rules in the
absence of a postal address;
• Thirdly, to apply correctly [3]Regulation (EC) No 1049/2001. Article
4(1)(b) of that Regulation refers to the protection of the privacy and
integrity of the individual and has to be applied in line with the
Data Protection Regulation;
• Fourthly, to protect the interest of other citizens and safeguard the
principle of good administration. The Commission has to treat all
citizens equally by ensuring that the legal framework for public
access to documents is respected. For example, it has to verify
whether Article 6(3) of Regulation (EC) No 1049/2001 is being evaded
by introducing several requests under different identities. Indeed, in
its Ryanair judgment ([4]EU:T:2010:511), the General Court confirmed
that Article 6(3) of Regulation (EC) No 1049/2001 cannot be evaded by
splitting an application into several, seemingly separate, parts. In
addition, the Commission has to make sure that the legal framework is
respected and the right of access to documents is not abused by making
requests under an invented identity.
The considerations above show that the request for and the consequent
processing of the applicant's postal address is not only appropriate, but
also strictly necessary for the performance of a task carried out in the
public interest within the meaning of Article 5(1)(a) of Data Protection
Regulation, namely providing a smooth and effective access to documents.

that person must bring the following two forms of identification:
1. A letter from you, the Receiver of the parcel, authorizing the
person to collect on your behalf and containing the following
information: (a) the name of the person collecting; (b) the DHL
Waybill No. for the shipment; (c) your full address; (d) your
signature;
2. A government-issued photo ID; for example, a driving license or
passport.
For collection from a Locker, only the PIN code you receive is
required to collect your shipment. A photo ID is not necessary.

I am filing the following confirmatory application with regards to my access to documents request 'African Parks and its operations'.
Dear Madam, Sir,
In your review, I would request that you again determine whether any documents, including e-mails and other forms of text correspondence, fall under the scope of my request, in particular points 3 and 4. The Commission addressed these two points with the comment: "No e-mails found in the database. Nothing to share." However, Regulation 1049/2001 applies to all documents held by the EU institution, not just those which have been registered in its database. In that regard, I refer you to the European Ombudsman's recent recommendations regarding text messages. (https://www.ombudsman.europa.eu/en/doc/c...) The Ombudsman said: "When dealing with requests for public access to documents that could cover text and instant messages, consider all locations where such messages might be stored, including electronic devices used by staff, and assist staff potentially holding such messages in their searches, for example by giving instructions." The same recommendation can be made with regard to e-mails.
We know from our sources that there has indeed been email and other text correspondence (points 3 and 4) between representatives from African Parks and representatives from the EU, specifically with EU representatives at the DG International Partnerships (formerly known as DG International Cooperation and Development (DevCo) / EuropeAid) and with the EU delegations in the African countries where African Parks has operations or where it is or has been prospecting (these delegations are notably - but not limited to - the ones in Kinshasa, N'Djamena, Bangui and Brazzaville). As early as 2005, African Parks' Annual Report mentions: "Governments and financial institutions; we have already been successful in persuading the European Union, and the US and Netherlands governments to contribute significant funds to our management model for specific parks. We have commenced discussions with the World Bank and the European Union to develop partnership funding arrangements which are built upon payment for delivering measurable outputs from the parks." So ever since 2004/05, there has been correspondence between the EU and APN, about the EU funding APN's projects and probably about other subjets as well.
In 2010, APN's Annal Report mentions: "The European Union, which has been funding Zakouma for the last 20 years played a particularly helpful role as facilitator in the negotiations [to establish a PPP between the government of Chad and APN] and has committed to funding the bulk of operating costs for the next five years."
On the EU side, some of the people who have definitely or probably exchanged emails and/or other forms of text messages with or about African Parks (APN) are Enrico Pironio, Gilles Desesquelles, Philippe Mayaux, Stefano Manservisi and Chantal Marijnissen. The APN correspondents definitely or probably include Peter Fearnhead, John Scanlon, Enrico Pironio, Gilles Desesquelles, François-Xavier de Donnea, Baudouin Michel, Jean Labuschagne, Jean Marc Froment, Ayesha Jackeria, Erik Marav, Andrea Heydlauff, Sophie Vossenaar and Tineke Floor.
We also know there have been more than two meetings between EU and APN representatives (point 1). Several Heads of EU Delegations have visited the parks in the DRC, CAR and probably in other countries.
We noticed that almost everywhere, budget amounts and names and budgets of suppliers were barred, because of "commercial interests". This is unjustified. It is in the public interest that citizens can control where EU funds go. We noted that some of the documents we received, such as this one, are available online without any redaction, whereas your services barred entire pages ("Partenariat Public Privés dans..." pp 110/111). In this particular example, showing how much EU money different NGOs received to manage different parks, there clearly is no question of any commercial interest.
In the case of AP's suppliers, we have strong indications of nepotism and other questionable business practices. While it may be true that the disclosure of certain information may harm the commercial interests of certain parties, there is an overriding public interest for its publication.
Another important issue is that the following documents contain some or many pages that are nearly or totally impossible to read. It looks like this is due to a technical problem, probably with the scanner.
