Are border-crossings of EU citizens recorded on Schengen borders?
Dear European Agency for the operational management of large-scale IT systems in the area of freedom, security and justice,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
Are entries of EU citizens that are not subject to any SIS alerts or warrants, that cross through Schengen land borders recorded in EU systems ?
If yes, for which retention period and based on which law or regulation?
If yes, which EU members states or instutions of these have access to this information?
Are EU/Schengen member states allow to record and retain information on EU citizens in their national systems, that cross through their Schengen borders into the Schengen area, but are not subject to any SIS alerts or warrants?
The requested information pertains to the case of an unsuspicious EU citizen not subject to any SIS alerts or warrants, i.e. an average EU citizen with valid documents returning from a holiday trip.
Yours faithfully,
An EU citizen

Question 1:
Are entries of EU citizens that are not subject to any SIS alerts or
warrants, that cross through Schengen land borders recorded in EU systems?
Answer: Access to the Schengen Area, and movement therein, by EU citizens
is not recorder in any of the IT large-scale systems managed by eu-LISA.
Question 2:
Are EU/Schengen member states allow to record and retain information on EU
citizens in their national systems, that cross through their Schengen
borders into the Schengen area, but are not subject to any SIS alerts or
warrants?
Answer: Member State authorities apply national legislation as well as the
legislation that governs the IT systems managed by eu-LISA. It is possible
that within the scope of national legislation, some member states record
information on EU citizens crossing their national borders.
