Dear Human Resources and Security (HR),

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting all documents which relate to any applications made under the Staff Regulations for authorisation for post-employment activities by Basil Mathioudakis. In particular, I request a note of all Mr Mathioudakis's job titles at the Commission including dates held; copies of any application(s) that he has made under the Staff Regulations to undertake a new professional activity; and all documents (correspondence, emails, meeting notes etc) related to the authorisation of the new role or roles.

Yours faithfully,

Dear Human Resources and Security,

Thanks for this reply. Your letter says that "Furthermore Mr Mathioudakis was reminded that during the two years after leaving the service, he should
notify the Commission when he intends to be involved in a specific activity related to those for which he was responsible in the Commission in the last three years of service and which could be of a nature such that an impartial observer could consider that there
is a connection with his duties during the last three years in service."

Does the fact that you have not sent me any information about any specific activities notified by Mr Mathioudakis mean that no such notifications have been received by the Commission? I ask because I consider that any such notifications would be covered by my original request.

I look forward to hearing from you.

Yours faithfully,

Vicky Cann

Dear Ms Cann,

Thank you for your e-mail dated 7 January 2016 whereby you request further
information following the Commission response of 4 January 2016 (Reference
Ares(2016)4931) to your access to documents request registered under
GestDem No 2015/6486.

We confirm to you that a document relating to a notification of activities
made by Mr Mathioudakis was covered in the Commission response of 4
January 2016. As indicated in the same response letter, the document you
requested contains personal data. It is the Commission's obligation to
ensure that the privacy and the integrity of the EU staff member
concerned, also in his professional capacity, are correctly protected.
This is why the exceptions to Regulation No 1049/2001 applied.

Yours sincerely,

Dear Human Resources and Security,

Please accept this as a confirmatory application on my request GestDem 2015/6486.

I was very surprised by the Commisison's handling of my access to documents request. I quite clearly asked for "all documents which relate to any applications made under the Staff Regulations
for authorisation for post-employment activities by Basil Mathioudakis".

In the reply received on the 4th January no documents were provided and in fact no list of documents was provided either. This opaque reply necessitated a further query from me, the response to which told me that "a document relating to a notification of activities made by Mr Mathioudakis was covered in the Commission response of 4 January 2016". But no information was provided about the document or even the activity. How I was expected to know that this document was covered by the reply of 4 January 2016 is not at all clear, when I was not even told of the existence of the document!

I do not ask for personal details like salary or email addresses. But I do request information to enable me to explore the way in which the Commission applies the Staff Regulations.

I would like to request, again, that all relevant documents to my original request are sent urgently.

A full history of my FOI request and all correspondence is available on the Internet at this address: http://www.asktheeu.org/en/request/basil...

Yours faithfully,

Vicky Cann
