Dear Secretariat General,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Secretariat General's handling of my FOI request 'Better Regulation and the Rights of the Child' GestDem No 2016/2664.

I do not find the reply received satisfactory.

The minutes provided were already known to me, as they are publicly available. It was on the basis of those documents that I requested public access to all documents, including impact assessment, internal and external correspondence, related to the Juncker Commission's decision to no longer prioritise children's rights, in light of the better regulation principles and no longer to have an overall programme or framework.

Here the relevant parts of the minutes:

minutes 7th meeting Informal Expert Group

The Belgian delegate inquired into a possible new EU Agenda on the rights of the child, to which the chair responded that, subject to agreement that a new EU Agenda proves its added value under the better regulation principles, DG Justice and Consumers hopes that a new EU Agenda will be adopted. A new EU Agenda would be expected to be holistic, relevant to all departments of the Commission, and would serve as a work programme ensuring that the Commission contributes adequately to its Treaty obligation to promote the protection of the rights of the child. This will all be under discussion in the coming months, with broad consultation among stakeholders, including probably an online public consultation. The BE delegate expressed his support for the development of a new agenda.

9th meeting Informal Expert Group

On the EU Agenda for the rights of the child (2011-2014) the Chair stated that all 11 actions have now been completed. The new Commission has decided that at this point in time no new Agenda will be adopted, in light of the better regulation principles, where it is preferred to have less action plans and strategies and focus on targeted actions. Nevertheless, the Commission will continue to promote the protection of the rights of the child and continue mainstreaming rights of the child across its policies, but without an overall programme or framework.
