Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

All documents related to the drafting of Commission Decision (EU) 2021/2121 of 6 July 2020 on records management and archives (C/2020/4482), including but not limited to:

- Any document containing an evaluation or assessment of the implementation of Decision 2002/47/EC, ECSC, Euratom (including but not limited to REFIT or other Better Regulation tool)
- Any document containing an evaluation or assessment of the implementation of Decision 2004/563/EC, Euratom (including but not limited to REFIT or other Better Regulation tool)
- The European Data Protection Supervisor opinion with recommendations from 3 March 2020 (as mentioned in recital 26 of Decision (EU) 2021/2121)
- Any assessment of the draft version(s) of Decision (EU) 2021/2121 by the Regulatory Scrutiny Board
- Any impact assessment of the draft version(s) of Decision (EU) 2021/2121
- Any internal consultations concerning draft versions of Commission Decision (EU) 2021/2121
- Any e-mails, minutes, progress reports, and other documents concerning draft versions of Commission Decision (EU) 2021/2121

I refer to my application for access to documents, which was registered on 21/01/2022 under reference number GESTDEM 2022/0490.

I would like to confirm that I received your reply and the attached documents.

I also would like to commend you for replying to my application within 15 working days. While that should be the normal practice, in my experience it is rather exceptional to receive a reply without the need for an extension of the deadline. So thank you!

Dear Madam, Sir,

I refer to my application for access to documents, which was registered on 21 January 2022 under reference number GESTDEM 2022/0490. On 11 February 2022, I received a reply, including a batch of 43 documents.

From at least on such document, an annex seems to be missing.

Ares (2020)1356845, a reply to the ISC from DG MARE, refers to an Annex: Decision with track changes. But the file 31 DG MARE Reply to ISC 2020 00857 Ares 2020 1356845 without personal data.pdf only contained the 4-page reply - not the annex.

Would you be so kind to send that annex?

Dear Mr Teffer,

Despite its title, the document you referred in your last email concerns
actually only the implementing rules, that are not part of Commission
Decision (EU) 2021/2121.

We sent to you the documents that were related only to the Decision or
both to the Decision and its implementing rules, but no document related
only to the implementing rules.
This is why the document you mentioned in your last email is not part of
the batch of 43 documents we sent to you.

However we can send you a copy of the document you requested in
attachment.
