To the European Food Safety Authority,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- All written communication since 1 October 2019 between EFSA and the European Commission concerning pathogen reduction treatment of poultry, pork or beef, including minutes of meetings, emails and any other kind of written communication between the two institutions on pathogen reduction treatment of poultry, pork or beef.

- A list of meetings and the minutes of meetings between EFSA and the European Commission concerning pathogen reduction treatment of poultry, pork or beef since 1 October 2019.

Dear Mr Haar,

I refer to your request for public access to documents of 2 March 2020, registered as PAD 2020/022 and processed by EFSA in accordance with Regulation (EC) No 1049/2001 regarding public access to documents (hereinafter “the PAD Regulation”).

With regard to the scope of your request, we understand you are interested in accessing documents concerning decontamination substances, i.e. substances other than potable water to remove surface contamination from products of animal origin within the meaning of Article 3(2) of Regulation EC 853/2004.

If so, please note that after internal verifications no documents in the possession of EFSA could be identified which fall within the scope of your request. EFSA is therefore not in the position to provide you with access to the documents you have requested. In that context, we should highlight that in application of the settled case law of the Court of Justice of the European Union, a presumption of legality attaches to any statement made by EU institutions and agencies concerning the non-existence of the documents requested (see McCullough v Cedefop, T 496/13, paragraph 50 (and case law cited), ECLI, EU:T:2015:374).

If you consider that the above interpretation of your request does not properly reflect the scope of your request, we would like to receive further clarifications from you and, if possible, with clear references to EFSA’s scientific output(s) and legal framework(s) linked to the documents of your interest.

We should highlight that this reply is without prejudice to your right to submit a new request for public access to documents in accordance with Regulation (EC) No 1049/2001. You may do so at any time, by writing to [email address].
