Dear European Ombudsman,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information: all the documentation related to a complaint made by The European Consumer Organisation regarding to European Commission and ENDOCRINE DISRUPTORS IN COSMETICS (Cosmetics Europe) (done the 30 November 2017).
I would like to have access to :
- European Ombudsman process documents depending on the status of the inquiry : No Inquiry or Solution proposal or Ombudsman recommendations (and Closing decision)
- Correspondance including emails, sent or received by officials working related to this complaint.

Dear Ms Toulemonde,

 

By e-mail of 13 March 2019, you asked the European Ombudsman’s Office for
public access to “all the documentation related to a complaint made by The
European Consumer Organisation regarding to European Commission and
ENDOCRINE DISRUPTORS IN COSMETICS (Cosmetics Europe) (done the 30 November
2017)”.

Your request was registered on 14 March 2019 under the reference number
Ares(2019)1692086.

We have dealt with your request in accordance with Regulation
1049/2001[6][1] regarding public access to European Parliament, Council
and Commission documents and the Ombudsman’s Decision on the handling of
requests for public access to documents[7][2].

We have identified 14 documents regarding case 2111/2017/MDC as falling
within the scope of your access request. For a list of the documents and
their reference numbers, please see the attached Excel sheet.

As you will see in the Excel sheet, the Ombudsman’s decision closing the
inquiry into the complaint is available on our website.

The Ombudsman did not make a solution proposal or a recommendation in this
case but closed it by decision of 7 February 2019 after having obtained
written comments from both the European Commission and the complainant.  

We have decided to grant you partial access to the documents.

We have redacted the documents with a view to protecting personal data in
accordance with Article 4(1)(b) of Regulation 1049/2001 together with
Regulation (EU) 2018/1725[8][3] of the European Parliament and of the
Council of 23 October 2018.

According to Article 4(1)(b) of Regulation 1049/2001, access to a document
(or parts thereof) shall be refused if its disclosure would undermine the
protection of privacy and the integrity of the individual.

Article 3(1) of Regulation 2018/1725 provides that personal data “means
any information relating to an identified or identifiable natural person
[…]”.

Should you wish to have access to the personal data thus redacted, you may
make a corresponding request. Please note that under Article 9(1)(b) of
Regulation 2018/1725 personal data shall only be transmitted to recipients
established in the Union other than Union institutions and bodies if “the
recipient establishes that it is necessary to have the data transmitted
for a specific purpose in the public interest and the controller, where
there is any reason to assume that the data subject’s legitimate interests
might be prejudiced, establishes that it is proportionate to transmit the
personal data for that specific purpose after having demonstrably weighed
the various competing interests”. You would thus need to demonstrate, in
your potential request, the necessity of having the personal data
transferred for a specific purpose in the public interest. [9][4]

Should you wish to challenge this decision, you may request a review under
Article 7(2) of Regulation 1049/2001 (‘confirmatory application’
procedure). You may do so by sending an e-mail to [European Ombudsman request email]
within 15 working days of having received this decision. A review request
would then be handled by our Secretary-General.
