We are informed that such complaint was received by your Office in 2004.
We would like to extend the periode of search from 2002 till 2006.

I am writing to you in relation to your request for public access to
documents registered under reference Ares(2024)887013.

In order to allow us to handle your request appropriately and efficiently
and in  accordance with Article 6(2) of Regulation 1049/2001 we would
appreciate if you could clarify your request.

 

Please note that over the years, the Office of the Ombudsman has used
various ICT tools to handle and manage documents, including those relating
to complaints. On each occasion, the Office migrated to more efficient
case management systems that allow for different types of searches and
filtering of cases.

 

However, the case management system which was used during the period of
your request, i.e. for the years 2002-2006, had more limited search
functionalities based on the name of the complainant or the case
reference.   

 

In your request you indicated that "[you were] informed that such
complaint was received by [the] Office".  In the circumstances, in order
to be able to identify any documents falling within the scope of your
request, we would appreciate if you could indicate either the name of the
complainant (or their representative) or the case reference.

 

We would appreciate to receive your clarification by sending an email to
[5][email address] as soon as possible and not later than 12
January COB in order to allow us to meet the strict deadlines under
Regulation 1049/2001.

According to the information we have, it concerned a complaint against the European Commission and the European Parliament.

The complaint came from German citizens.

Most likely during the first six months of 2004.

I am writing in reply to your request for public access registered under
reference Ares(2024)887013 of 6 February 2024 .

 

You sought public access to a complaint to the Ombudsman made in 2004
concerning the issue of “intercountry adoption of Romanian children”
without providing further details. 

 

We have dealt with your request in accordance with Regulation 1049/2001
regarding public access to EU documents[5][1] as well as the Ombudsman’s
Decision on the handling of requests for public access to documents.[6][2]

 

On 7 February 2024, we informed you that the case management system, which
was used at the time had very limited search functionalities. Thus, we
asked you to clarify your request in accordance with Article 6(2) of
Regulation 1049/2001. You replied that the complaint was from German
citizens and concerned the European Commission and the European
Parliament.

 

Please note that in 2004, the Ombudsman received 3 726 complaints, around
931 complaints were within the Ombudsman’s mandate.[7][3]   

Based on the limited information you provided in your request and further
clarifications, we could not identify any specific document that would
correspond to the description in your request.

 

Should you wish to challenge this decision, you may request a review under
Article 7(2) of Regulation 1049/2001 (‘confirmatory application’
procedure). You may do so by sending an e-mail to

decision.
