Confirmatory application decisions of the European Commission, concerning requests for access to documents pertaining both to concrete trilogue negotiation files, and documents pertaining to the trilogue negotiation method in a general sense, for the period from 2001 until 2009.

Should the above request be considered to entail a significant administrative burden, I am willing to discuss the possibilities of breaking the above request into smaller subcomponents, in order to avoid undue delay and obtain access in the most expedient manner.

Thank you for your interest in trilogue files and in the trilogue
negotiation method. Your requests of 5 August show that you have an
interest in general in trilogues.

 

You requests concerning confirmatory decisions of the European Commission
regarding this subject matter cover a wide range of years, which taking
into account the number of confirmatory applications per year (around 300)
would certainly entail a significant administrative burden and would not
be able to be handled within the deadlines prescribed by Regulation
1049/2001.

 

You kindly signal your willingness to discuss possibilities to limit this
administrative burden. One possibility would be to make a request for
information instead of a request for access to documents. This would allow
the Commission services to reply to your request providing the information
that they have at their disposal, for example regarding your request
focusing on the Commission policy and/or formal positions regarding the
trilogue negotiation method in the ordinary legislative procedure.

 

As regards your requests to obtain access to confirmatory decisions of the
European Commission concerning requests for access to documents pertaining
both to concrete trilogue negotiation files and documents pertaining to
the trilogue negotiation method in a general sense for the periods from
2001 to 2001 and 2010 to today, pls note that the IT tools at the disposal
of the European Commission do not support a targeted search for filtering
out these confirmatory decisions. As you can understand, any manual search
in around 300 cases per year would be both very time consuming and
excessive in terms of administrative burden.

 

To avoid this, it would be helpful if you specify the kind of information
you are looking for, so as to allow us, to propose the best way to handle
your requests. In the light of the above, we will not yet register your
requests as requests for access to documents.

Many thanks for your response. In your response, you highlight, understandably, that a search for specific characteristics in several years' worth of confirmatory applications constitutes a significant administrative burden.

An alternative would be for me to rephrase my current request to cover ALL confirmatory applications between 2001 and 2009. Assuming that the Commission's policy on disclosure of confirmatory applications is the same as that of the Council, namely one of semi-automated disclosure excluding personal data, this should constitute a significant reduction in the administrative burden caused by my request.

For my purposes of scientific analysis, it is not necessary to know the identity of the applicant. Merely the content of the Commission's response suffices. Naturally, the most efficient way of delivering the documents would be via email. The Council generally provides larger batches of documents as .zip files, although other solutions are also imaginable.

Please let me know whether the proposed solution would be workable. If it is, please consider the current letter as a fresh access to documents request under Regulation 1049/01 for the above-mentioned documents ("An alternative would....2001 and 2009.").
