Correspondence between the EU Delegation in Baku and Member States

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
- All the correspondence, preparatory documents, work documents, drafts and verbal/written notes exchanged between any member of the EU Delegation in Baku and the EU State Members' officials between February 1st 2022 and October 8th 2024, in which "energy", "Russia", "Memorandum of Understanding", "gas", "oil", "electricity" and/or "COP29" are mentioned.

The description given in your application is excessively broad and does
not enable us to efficiently search for documents that could be in your
interest. In fact, please note that our case management systems does allow
for searches by keywords present only in the title of the documents.
Moreover, the word “Russia” and well as “Memorandum of Understanding” are
likely to produce a high number of results falling outside the scope of
your interest.
We therefore invite you, in accordance with Article 6(2) of Regulation
(EC) No 1049/2001 regarding public access to documents, to provide us with
clear scope and information allowing us to identify the document(s)
falling within your application, such as references and exact subjects.

We thank you for your proposal aimed at narrowing down the scope of your request, in particular as regards liming the search to documents exchanged between the Delegation and State Members' officials from Slovakia, Czech Republic, Slovenia, Italy and France between February 1st 2022 and October 8th 2024.
However, as regards including any of the four terms (“Russia”, “Memorandum of Understanding”, “gas”, “COP29”) in the search, it would still lead to a disproportionate amount of documents and to an excessive workload for the institution, which would notably have an impact on the respect of the deadlines imposed by Regulation 1049/2001 to reply to your application.
In an attempt to find a fair solution on the limitation of the scope of your request, in line with Article 6(3) of the Regulation and the applicable case law, we would like to propose to limit the scope of your request to documents that include all the four above mentioned terms together. In fact, we consider that this solution would effectively balance your interest in receiving a reply to your request within the deadlines provided by Regulation 1049/2001 on one hand, and the administrative burden imposed on the institution in light of the broad request on the other.
We look forward to your cooperation for ensuring that the present request is addressed efficiently and within the deadlines of the Regulation, that will start running from the moment in which we find an agreement on the scope of your application.
