Dear Mr. Panichi,

Following your request regarding public access to documents, you mentioned
in your email dated 6th October 2015 that you are interested by "all
correspondence relating to claims of harassment from Robert McCoy, from
January 1, 2013 to December 31, 2014. Including reports and email
attachments.

Only two documents were identified falling under the scope of your
request.

Indeed, in two judgments of the European Union Civil Service Tribunal
(Case F-86/11 and Case F-156/12; see
[2]http://eur-lex.europa.eu/homepage.html?l...), respectively dated
March 7^th 2013 and November 18^th 2014, the terms of "psychological
harassment" are quoted, but without being a judicial recognition of such a
situation.

However, in connection with these two judgments, under the exception of
Article 4(2) second indent (protection of court proceedings) of Regulation
1049/2001, we consider that we cannot disclose the correspondence relating
to the court proceedings.

In accordance with Article 7(2) of Regulation 1049/2001, you are entitled
to make a confirmatory application requesting the Committee of the Regions
to review this position.

Such a confirmatory application should be addressed within 15 working days
upon receipt of this letter to the Secretary General of the Committee of
the Regions at the following address:
