document has to be refused if its disclosure would undermine the
protection of privacy and the integrity of the individual, in particular
in accordance with Union legislation regarding the protection of personal
data. The applicable legislation in this field is Regulation (EU) No
2018/1725.

When access is requested to documents containing personal data, Regulation
(EU) No 2018/1725 becomes fully applicable. According to Article 9.1(b) of
this Regulation, personal data shall only be transferred to recipients if
they establish the necessity of having the data transferred to them and if
there is no reason to assume that the legitimate rights of the persons
concerned might be prejudiced.

We consider that, with the information available, the necessity of
disclosing the aforementioned personal data to you has not been
established and/or that it cannot be assumed that such disclosure would
not prejudice the legitimate rights of the persons concerned. Therefore,
we are disclosing the documents requested expunged from this personal
data. In particular, we have redacted all names, surnames, email addresses
and other personal identifiers.

Please be informed that in accordance with Article 7(2) of Regulation
1049/2001, you may, within 15 working days from receipt of this letter,
make a confirmatory application asking the EEA to reconsider its position

Considering that your application covers an extensive period of time and a
large number of documents, which need to be assessed individually, in
accordance with Article 6(3) of Regulation 1049/2001, we proposed to
firstly provide you with the documents already identified and analysed and
to proceed with further analysis and identification of relevant documents
to be provided to you in a follow-up response. You did not object to the
proposed solution.

In addition to the documents sent to you on 15th September 2023, the
following documents have been identified as falling under the scope of
your request:

The above documents are third-party documents, namely originating from
Concawe, and in accordance with Article 4(4) of the Regulation, the EEA
consulted the third party with a view to assessing whether an exception to
disclosure would apply. Having examined the above documents, and following
consultation with Concawe, we have come to the conclusion that the
documents can be fully disclosed. You will find them attached.
