I would like to point out that the time-limit for replying to requests for
access to documents is 15 working days from the registration of the
request.  

As indicated in the acknowledgment of receipt of your application, the set
deadline was 16 November 2012 (please note that in this period Belgium
bank holidays were included).

 

We are in the process of finalizing the full reply but are regrettably not
able to provide this within the set deadline.

Therefore a holding reply is forthcoming in accordance with the legal
provisions of Regulation (EC) No 1049/2001.

 

Please note that the full answer should follow very shortly after.

I apologize for the additional delay and hope we can count on your
understanding.

On 15th November in your first reply you wrote that 'in accordance with Article 7(3) of the Regulation (EC No 1049/2001) you 'need to extend the time-limit by 15 working days'.

I note that Article 7 (3) states: "In exceptional cases, for example in the event of an application relating to a very long document or to a very large
number of documents, the time-limit provided for in paragraph 1 may be extended by 15 working days, provided that the applicant is notified in advance and that detailed reasons are given".

I also note that in your second submission of 15th November you indicated that 'the full answer should follow very shortly after'.

I do not believe you have given any reasons for the delay and neither do I believe the application relates to 'a very long document or to a very large number of documents'.

A further 6 working days have now elapsed since that reply, and with the holiday season approaching I would very much welcome your expediting your response in the spirit of your 'very shortly thereafter' comment above. In other words I sincerely hope you are not going to take a full 15 extra days for performing a simple task that should involve looking at one invoice and a series of backup timesheets and expense receipts.
