Council Directive 95/7/EC

We're waiting for Peter Bennet to read recent responses and update the status.

Dear Taxation and Customs Union,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Council Directive 92/111/EEC of 14 December 1992 amending Directive 77/388/EEC
Article 1 (9) said that The Commission would present proposals to amend the exemption for supplies of goods to be carried in the baggage of travellers previously inserted by Council Directive 95/7/EC, Article 3.

and

Council Directive 95/7/EC of 10 April 1995 amending Directive 77/388/EEC
Contained the amendments so proposed. However, there are no papers linked to the relevant pages of the EurLex web site that explains the thinking, rationale or intention of the revised wording

Please provide any working papers you have which will explain the thinking, rationale and intention of the revised wording.

Thank you for your note requesting further clarification.
As I indicated Council Directive 92/111/EEC Article 1(8) said that The Commission will submit the proposals specified to the Council.
Directive 95/7/EC Article 1(3) brought into law the result of these proposals.

I am presuming that there must have been discussions within the Commission and between the Commission and the Council and indeed the tax authorities of the Community as to what the aims and objectives of the proposals were and to discuss what would likely have been an iterative process.

It is these background papers I am looking for.

Your application is currently being handled. However, we will not be in a position to complete the handling of your application within the time limit of 15 working days, which expires on 23/02/2018.

An extended time limit for more in-depth investigation is needed in order to complete our assessment on the possibility for the public disclosure of the document requested.

Therefore, we have to extend the time limit with 15 working days in accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding public access to documents. The new time limit expires on 16/03/2018.

We apologize for this delay and for any inconvenience this may cause.
