Court's procurement procedures without publication between 2013 and 2023

Dear Court of Justice of the European Union,

Under the right of access to documents in the EU treaties and pursuant to Article 5 (4) of the
decision of the Court of Justice of the European Union (CJEU) of 26 November 2019 concerning public access to documents held by the Court of Justice of the European Union in the exercise of its administrative functions (OJ 2020 C 45/2, 'Decision of November 26, 2019'), please provide the following documents and information:

-- list of all procurement procedures between 2013 and 2023 awarded without prior publication via direct contracts or negotiated procedures, including amounts, scope, duration and awardees
-- explain please if the Court launches procurement procedures on behalf of the entire institution or on behalf of individual Directorates or on behalf of each jurisdiction (Court vs. Tribunal/General Court)
-- explain please if the Court receives Offers from tenderers in any EU language and from any EU member state, or if imposes geographical restrictions provide details

You have sent your application to the Court's Registry. The Registry has
forwarded it to us, since it is the Access to documents section which is
responsible for dealing with the applications for access to a document
held by the Court in the exercise of its administrative functions, as you
have noticed with your previous applications 0019/2022D, 0020/2022D,
0021/2022D and 0006/2023D.

 

In this respect, we would like to remind you that in order to make an
application for access to a document held by the Court in the exercise of
its administrative functions, applicants are invited by Article 4 (1) of
the Decision of the Court of Justice of the European Union of 26 November
2019 concerning public access to documents held by the Court of Justice of
the European Union in the exercise of its administrative functions (OJ
2020 C 45/2, 'the Decision') to fill in the form available at the bottom
of the [1]dedicated page of the CURIA website (online or in PDF version),
as you did for your application 0019/2022D. This form generates
automatically an e-mail which sends any new application to the said
section.

 

Furthermore, in order to check the conditions of admissibility set out in
Article 2 of the Decision, and thus to be able to process your application
properly, I would ask you to provide us with your residential address.

Dear Madam,

 

In our e-mail of May 12, we asked you to provide us with your address. You
did so by e-mail, indicating as your residential address 42 vjal Ragusa
Il-Mosta, MST 2309, Malta. However, according to the information at our
disposal, there are no residential or commercial premises at the address
you gave. In fact, it appears to be an empty building site. 

 

Article 2(1) of the Decision of the Court of Justice of the European Union
of 26 November 2019 regarding public access to documents held by the Court
of Justice of the European Union in the exercise of its administrative
functions (2020/C 45/02) provides that "Any citizen of the European Union
and any natural or legal person residing or having its registered office
in a Member State has a right of access to the documents of the Court of
Justice of the European Union referred to in Article 1(1) under the
conditions laid down in this Decision". 

 

In order to verify that the conditions of the aforementioned Article 2 are
met, we invite you to provide us with proof that you are effectively and
legally resident at the aforementioned address or that you are a European
citizen.

 

Otherwise, we will not be able to process your request.
