Dear Mr Hoedeman,

 

Thank you for your e-mail of 7 March 2017 sent on behalf of Corporate
Europe Observatory (CEO) requesting access to:

Association and others) in which the issue of rubber granules for
artificial turf fields (crumb rubber) was discussed (between November 2014
and today);

 

- all correspondence (including emails) between ECHA and industry
representatives (including European Tyre & Rubber Manufacturers'
Association and others) in which the issue of rubber granules for
artificial turf fields  (crumb rubber) was discussed (between November
2014 and today).

 

ECHA is committed to treat requests under the ATD Regulation within the
shortest timeframe possible and within the legal deadlines.

 

In accordance to Article 4(4) of Regulation (EC) No 1049/2001 on public
access to documents (the “ATD Regulation”), ECHA is obliged however to
launch several third party consultations for the information originating
from third parties. After obtaining the input from the third parties, ECHA
must carry out the assessment of the replies of the third parties in light
of the ATD Regulation. ECHA must also ensure, in case of disagreement, the
right of third parties to lodge an action for annulment and interim
measures against a decision of ECHA.

 

We have already prepared for the purpose of your application for access to
documents the call for evidence (see attached).

 

Taking into account the above, already now it can be envisaged that it
will be extremely difficult for ECHA to provide you with the rest of the
relevant document within the timeline provided for by the ATD Regulation
(including the extension of deadline) i.e. within 15+15 working days.

 

In light of the above, as provided for by Article 6(3) of the ATD
Regulation, we would like to propose a fair solution in order to ensure
that all ECHA’s legal obligations are being met and with a view to
disclosing the requested document as soon as possible. We propose to send
you a final reply on your access to documents request by 31 May 2017, i.e.
21 working days longer than the standard deadline. Please note that we
have already disclosed part of the requested documents. ECHA will strive
to send you the remaining requested documents as soon as possible.

 

You are kindly requested to inform us whether you agree to this proposal
by 27 March 2017. If we do not hear from you within the above timeframe,
we will close the inquiry into your application.
