Decision reached on Case 1102/2021/VB

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
The decision, and/or summary of the decision reached on 23 September, 2021 for case "1102/2021/VB", concerning "The European Commission’s alleged failure to keep the complainant informed on the state of play of an infringement complaint about Member States’ intergovernmental agreements with the United States for the implementation of the Foreign Account Tax Compliance Act (FATCA)".

Dear Mr Lee,
On 19 October 2021, you asked the European Ombudsman’s Office to grant you
public access to “the decision, and/or summary of the decision reached on
23 September, 2021 for case 1102/2021/VB.
Your request has been registered on 19 October 2021, under the reference
Ares (2021)6402545.
We have dealt with your request in accordance with Regulation
1049/2001[5]^^[1] regarding public access to documents and the Ombudsman’s
Decision[6]^^[2] on the handling of requests for public access to
documents.
I would like to inform you that we have identified the following two
documents as falling within the scope of your request:

We have decided to grant you partial access to the documents above. As you
will see from the decision, the Ombudsman’s inquiry aimed at providing the
complainant with a reply. It did not concern the substance of the matter
the complainant contacted the European Commission about. The minor
redactions of the documents relate to the protection of personal data in
accordance with Article 4(1)(b) of Regulation 1049/2001 together with
Regulation 2018/1725[7]^^[3].
According to Article 4(1)(b) of Regulation 1049/2001, access to a document
(or parts thereof) shall be refused if its disclosure would undermine the
protection of privacy and the integrity of the individual.
Article 3(1) of Regulation 2018/1725 provides that personal data “means
any information relating to an identified or identifiable natural person
[...]”.
Should you wish to have access to the personal data thus redacted, you may
make a corresponding request. Please note that according to Article
9(1)(b) of Regulation 2018/1725 you would need to demonstrate the
necessity of having the personal data transferred for a specific purpose
in the public interest and show that there is no reason to assume that the
legitimate interests of the data subject might be prejudiced.
Should you wish to challenge this decision, you may request a review under
Article 7(2) of Regulation 1049/2001 (‘confirmatory application’
procedure). You may do so by sending an e-mail to

decision. Our Secretary-General would then handle the review request.
