We refer to your e-mail, dated 27 January 2020 in which you make a request
for access to documents pursuant to Regulation (EC) No 1049/2001 of the
European Parliament and of the Council of 30 May 2001 regarding public
access to European Parliament, Council and Commission documents
(hereinafter ‘Regulation 1049/2001’), registered under the above-mentioned
reference number.

 

In your application, you ask for the following documents:

 

“a list of all lobby meetings held with DG CNECT since 1 January 2019,
where the proposed ePrivacy regulation was discussed. The list should
include the names of the individuals and organisations attending; the
date; and any agendas / minutes / notes produced. I would additionally
like to receive any position papers, emails, or other correspondence which
relates to the proposed ePrivacy regulation.”

 

Your application concerns a very large number of documents which need to
be assessed individually. Within the scope of your request we have so far
already identified around 128 documents distributed per category as
follows:

 

-       Position papers: 22 documents

-       Emails: 18 documents

-       Other correspondence: 88 documents (these documents include:
letters from MEPs (1 document); questions or petitions submitted by
citizens (5 documents); European Parliamentary questions (8 documents);
replies to European parliamentary questions and to petitions/questions
from citizens and position papers (18 documents); letters sent following
the Transport, Telecommunications and Energy Council (TTE Council) in
December 2018 (56 documents))

 

According to our preliminary assessment of the workload estimate involved
in the handling of your request, the handling of all documents falling
under the scope of your request would cover the following steps:

-          Search for possible additional documents falling within the
scope of your request;

-          Retrieval and establishment of a complete list of the documents
falling under the scope of your request;

-          Preliminary individual assessment of the content of the
documents in light of the exceptions contained in Article 4 of Regulation
1049/2001;

-          Possible need to consult third parties and other services
within the European Commission on the documents identified;

-          Final assessment of the documents in light of the comments
received;

-          Redaction of those parts of the documents to which one or
several exceptions apply;

-          Preparation and finalisation of the reply for the requests;

-          Preparation of the replies and the documents for dispatch.

 

It follows from the above that the work needed for the treatment of your
request constitutes a severe administrative burden. Furthermore, due to
the wide material scope of your request, the work cannot be expected to be
completed within the time limits set out in Article 7 of Regulation
1049/2001.

 

Article 6(3) of the Regulation 1049/2001 provides that, in the event of an
application relating to very large number of documents, the institution
concerned may confer with the applicant informally with a view to finding
a fair solution. In accordance with the case law of the Union Courts, the
proposal for a fair solution aims to balance the interest of the applicant
against the workload resulting from the processing of the application in
order to safeguard the interests of good administration (Judgments of 6
December 2001, Council v Hautala, Case C 353/99 P, EU:C:2001: 661, para.
30, and of 2 October 2014, Strack v Commission, Case C 127/13 P,
EU:C:2014:2250, para.27). Such solution can only concern the content or
the number of documents applied for, not the deadline for replying
(Judgment of the Court of Justice of 2 October 2014 in case C- 127/13,
Guido Strack v Commission, paragraphs 26-28). This means that the scope of
the request must be reduced in a way that would enable its treatment
within the extended deadline of 15 + 15 working days.

 

Based on the above-mentioned provision, we kindly ask you to specify the
objective of your request, your specific interest in the requested
documents (Judgment of the Court of Justice of 2 October 2014 in case
C-127/13, Guido Strack v Commission, paragraph 28; Judgment of the General
Court (then 'Court of First Instance') of 22 May 2012 in case T-344/08,
EnBW Energie Baden-Württemberg v Commission, paragraph 105 ) and to narrow
down the scope of your request, so as to reduce it to a more manageable
amount of documents.

 

If you are not in a position to specify your interest or to propose a
limitation of the scope, we propose that our further assessment against
Article 4 of Regulation 1049/2001 is limited to the following restricted
scope:

 

-          A maximum of 20 documents to be chosen from two of the
categories mentioned above

 

Nevertheless, the number of documents identified and assessed will depend
on the volume of the documents and the potential need to consult third
parties on their disclosure.

 

In order to enable us to respect the time limits of Regulation 1049/2001,
we would ask you for a swift response to our proposal for a fair solution,
and within three working days at the latest.

I am filing the following confirmatory application with regards to my access to documents request 'DG CNECT ePrivacy lobbying' which you registered as GestDem 2020/490.

While I was granted access to the majority of documents listed, I was very disappointed not to be given access to documents 5 and 10. Nor have I been told about the originator of the requests; when I asked to have this specific information, partly to enable me to decide whether or not to put in a confirmatory application to request the missing documents, I was told that that information also could not be provided.

There should be no place for lobbying of the Commission that is kept entirely secret, especially when it is by those with commercial interests in a proposed EU regulation. This confirmatory application requests that you re-consider, both the refusal to release the names of the organisations that were lobbying via documents 5 and 10, and the decision to refuse access to the documents submitted themselves. There is a good public interest rationale for the Commission to be fully open with the public about the lobbying that it receives, especially on such a hotly-contested topic as ePrivacy.

I can confirm, that I do not wish to receive personal data such as signatures and contact details.

of Regulation (EC) No 1049/2001 regarding public access to European

Your confirmatory application are currently being handled. Unfortunately,
we have not yet been able to gather all the elements needed to carry out a
full analysis of your requests and to take final decisions. Therefore, we
are not in a position to reply to your confirmatory requests within the
prescribed time limit which expires on 4 May 2020.

 

Consequently, we have to extend this period by another 15 working days in
accordance with Article 8(2) of Regulation (EC) No 1049/2001. The new
deadline expires on 27 May 2020.

 

I regret this additional delay and sincerely apologise for any
inconvenience this may cause.

I also refer to our holding reply of 30 April 2020, by which the time
limit for replying to your confirmatory applications was extended by 15
working days, pursuant to Article 8(2) of Regulation 1049/2001. This
extended time limit expires on 27 May 2020.

I regret to have to inform you that we will not be able to respond within
the extended time-limit, as we have not yet finalised internal and
external consultations.

I can assure you that we are doing our utmost to provide you with a final
reply as soon as possible.
