DG GROW contacts re. pharma incentives study

Dear Internal Market, Industry, Entrepreneurship and SMEs,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

(i) a list of meetings; (ii) minutes or other reports of those meetings; and (iii) all correspondence (including emails) between DG GROW officials/representatives and private companies, industry associations, consultancies or law firms acting on their behalf, or patients groups, pertaining to the “Study on the economic impact of supplementary protection certificates, pharmaceutical incentives and rewards in Europe” conducted by Copenhagen Economics. The scope of this request should be considered to concern the period between April 2017 and May 2018.

In addition, I would like to request (iv) a list of the stakeholders that Copenhagen Economics interviewed in the preparation of its study (cf. page 11 of the study’s Executive Summary refers to “more than 20 interviews with stakeholders” being conducted).

I would be grateful if you could take the Code of Good Administrative Behaviour into account when considering (i) and (iv) of this request.

With regard to my emails of 8th and 24th January 2019 (copied below), requesting an urgent response regarding your long-delayed reply to my request GestDem 2018/5805, which was made on 12th October 2018, I hereby politely inform you that if I have not received a reply from you by the end of this working week (ie 1st February 2019), I will be making a complaint to the European Ombudsman.

The European Ombudsman, Emily O'Reilly, has stated that “Citizens need to try access documents while they are still relevant. Information delayed is information denied”. Therefore, the 'fast-track' complaint procedure for access to documents requests includes the provision for complaints to be made in face of delays by EU institutions in releasing documents, and when the institution in question has not replied.
