Please clarify the exact date of receipt of my application for access to documents.

According to Article 7 para. 1 of Regulation 1049/2001, an application for access to a document shall be handled promptly.

Please substantiate why the registration date of my receipt is 8 November, although the additional requirement to submit a postal address was a minimal change which did not influence the content of my request and cannot be considered as a new application. The factual submission of my request for access to documents was done on 27 October.

We apologise for the delay in the registration of your application sent on 27 October 2017 and registered on 7 November 2017.

As you probably know, the Commission has been on public holiday on 1 and 2 November, leading to reduced staffing during the whole 44th week. On the other hand, the unit that ensures the administrative follow up of requests for access to documents has been under a very heavy current workload due to the publication of a major IT call for tenders the day before your application was received. This has led to a delay in the registration process of your application.

We confirm that the date of registration of your application is 7 November 2017.

The postal address is a mandatory field in order to register an application for access to documents; without your address, the request may not be registered. Moreover, when using AsktheEU.org, the mandatory elements for the registration are not mentioned and the registration is not automatic. As indicated before, the European Commission cannot be held accountable for any problems linked to the use of AsktheEU.org

In order to avoid any problem in your future applications, you may want to use the official form (https://ec.europa.eu/transparency/regdoc...) that clearly states which are the mandatory fields for the registration of the application. Please note that if a complete application is submitted through this form, its registration will be automatic.

Thank you for your request to narrow down my initial request for access to documents in order to reduce it to a more manageable amount of documents.

As a response to your letter from 24 November 2017, I would like to specify my request and to ask to release the deliveries of the FOSSA project that were promised to be be made publicly available:

1. Deliverable WP4-01: Inventory of Open Source Software used in the European Commission and the European Parliament

2. Deliverable WP4-02: Dissemination material

Based on the list of documents enclosed to your letter of 24 November 2017 in Annex 1, I would like to request to prioritise the following documents when processing my request for access to documents of 27 October 2017:

DLV6 - Annex 1 - Inventory Summary
DLV6 - Annex 2 - list of all software with instances
DLV6 - Annex 3 - List of OSS with instances
DLV6 - Annex 4 - OSS by system type

I understand that the request to prioritise the aforementioned documents may result in a lot of work that cannot be carried out on within the normal time limits set out in Article 7 of Regulation 1049/2001, and therefore, I would like the European Commission to propose a reasonable deadline for granting access to these documents. I, nevertheless, urge DG Informatics to prioritise publication of the aforementioned documents as soon as possible.

We thank you for having taken the time to discuss the fair proposal made by DIGIT in answer to your request for access to documents (GESTDEM 2017/6717).

During this conversation, you confirmed that your main objective is to reach an agreement on the publication of the content of the deliverables of WP04, and that this publication should be prioritised over a disclosure of the documents in answer to your request under Regulation 1049/2001.

That being said, we proposed, rather than releasing the documents according to Regulation 1049/2001, to create a new, self-reading version of the documents that we undertake to publish by the end of January. This publication would be done outside of the scope of the Regulation, as the Regulation does not allow any extension of deadlines and has very strict rules as for how the redaction of information should be done.

Therefore, we would ask you to temporarily withdraw your request (except for the documents that have already been provided to you) to give us the flexibility to publish the documents in the scope of the WP04 in a readable format by the end of January.

Of course, should you not be satisfied with the outcome of the publication, you would remain fully entitled to launch a new request for access to documents.

Could you confirm that you agree with this approach?
