referring to documents filed by Ireland in case C-398/15. In accordance

Dear Mr Logue

 

We refer to your above mentioned application dated 18/07/2017 in which you
make a request for access to documents, registered on the same day under
reference number GestDem 2017/4250.

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires today on 09/08/2017.

An extended time limit is needed as your application concerns a document
of which the Commission is not the author. According to Article 4(4) of
Regulation 1049/2001, the Commission therefore has to consult the third
party, in this case the Irish government from which the document
originates. The consultation period is still ongoing and adds an
additional administrative step to the handling of your access request.

Moreover, following the judgment of the Court in Case C-213/15P, Breyer,
the Commission has received a large number of access requests concerning a
very large total number of documents.

Therefore, it will not be possible to provide you with the reply within
the time limit set by Article 7(2) of Regulation (EC) No 1049/2001
regarding public access to documents. A reply will be provided to you as
soon as possible.

We apologise for this delay and for any inconvenience this may cause.

Can you confirm that this is an extension of time under Article 7(3) of Regulation 1049/2001 and confirm the date on which the request will be answered? If this is not the case can you cite the relevant provision of article 1049/2001 that you are relying on to delay answering this request.

I would note that consulting a third party does not constitute an exceptional circumstance justifying delaying a a response since the third party must provide whatever submission it wishes to make within the time period set out in 1049/2001
