Dear European Ombudsman,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

For the period between 1 January 2019 to date:
- a list of all meetings held with the European Data Protection Supervisor (EDPS), the Inter-Organisational Communications Committee (IOCC), and other institutions regarding EU Voice, EU Video and open source social media (Mastodon, Peertube, or other Fediverse related instances). The list should include: date of the meeting, individuals attending and their organisational affiliation, as well as the issues discussed;
- all minutes and other reports of these meetings;
- all correspondence, including attachments (including, but not limited to, emails, letters, and/or telephone call notes), between your institutions and any of the above-mentioned, including any intermediaries representing their interests; and
- all documents prepared for the purpose of these meetings and/or exchanged during the course of these meetings.
- all reports, summaries, minutes, notes, or record-keeping of any kind produced by your institution as an outcome of these meetings.
- all reports, summaries, minutes, notes, or record-keeping and documents of any kind produced by your institution of internal meetings relating to EU Voice, EU Video and open source social media (Mastodon, Peertube, or other Fediverse related instances), including date of the meeting, individuals attending and their organisational affiliation, as well as the issues discussed;
- any social media strategy documents and budget allocations related to EU Voice, EU Video and open source social media (Mastodon, Peertube, or other Fediverse related instances).
- and complaints made regarding EU Video or EU Voice, as well as decisions and outcome documents related to those complains

Dear Mr Mechels,
We refer to your e-mail of 30 September 2024, by which you requested
public access to documents concerning EU Voice and EU Video. Your
application is currently being handled. Unfortunately, we regret to inform
you that we were not in a position to reply to you within the initial
deadline. Therefore, in accordance with Article 7(3) of Regulation
1049/2001 regarding public access to documents, we need to extend the time
limit to reply by 15 working days as external consultations are still
ongoing.
The new time limit expires on 14 November 2024 though we will do our best
to revert to you as soon as possible.

Dear Mr Mechels,
On 2 October 2024, via the platform asktheeu, you requested public access
to documents concerning the European Data Protection Supervisor's (EDPS)
pilot of two social media platforms: EU Voice and EU Video.
We registered your request on the same day under reference
Ares(2024)6979538.
We have dealt with your request in accordance with Regulation
1049/2001[5][1] regarding public access to European Parliament, Council
and Commission documents as well as the Decision of the European Ombudsman
on the handling of requests for public access to documents[6][2].
On 25 October 2024, we informed you about the need to extend the deadline
to reply by 15 working days with a view to concluding external
consultations with the Commission and the EDPS in line with Article 4(4)
of Regulation 1049/2201.
We have identified 27 documents as falling within the scope of your
request. A list of documents is attached to this email.
Parts of some documents were redacted as they fell outside the scope of
your request because they did not relate to alternative social media
platforms. These parts are indicated as such in the documents.
We have decided to grant you partial access to the documents and parts
thereof that fell within the scope of the request. We have redacted these
documents with a view to protecting (i) personal data in accordance with
Article 4(1)(b) of Regulation 1049/2001 and with Regulation
1725/2018[7][3].
According to Article 4(1)(b) of Regulation 1049/2001, access to a document
(or parts thereof) shall be refused if its disclosure would undermine the
protection of privacy and the integrity of the individual. Article 3(1) of
Regulation 1725/2018 states that personal data means “any information
relating to an identified or identifiable natural person [...]”.
For the sake of completeness, it should be added that, pursuant to
Article 9(1)(b) of Regulation 1725/2018, personal data shall only be
transmitted to recipients established in the Union other than Union
institutions and bodies if “the recipient demonstrates that it is
necessary for the data to be transmitted for a specific purpose of public
interest and the controller, where there is reason to assume that the
legitimate interests of the data subject might be prejudiced, demonstrates
that it is proportionate to transmit the personal data for that specific
purpose after a demonstrable assessment of the various conflicting
interests”. You would thus need to demonstrate the necessity of having the
personal data transferred for a specific purpose in the public interest
and show that there is no reason to assume that the legitimate interests
of the data subjects would be prejudiced[8][4]. We have not identified
this to be the case here.
Should you wish to challenge this decision, you may request a review under
Article 7(2) of Regulation 1049/2001 (‘confirmatory application’
procedure). You may do so by sending an e-mail to

decision.
