EEA and British Nationals clarification.
Dear European Parliament,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
Brexit negotiations will have a big impact on the life of several millions of people - EEA Nationals that live and work in UK and British Nationals that live and work in EU.
Under the right of access to documents in EU treaties, please reveal what are the plans regarding the legal status of the EEA nationals living in UK and the British citizens living in EU countries, if the Brexit negotiations fail? How the EU parliament has decided to proceed in a No Deal scenario?
Yours faithfully,
Skerdian Kerri

Dear Skerdian Kerri,
The Citizens’ Enquiries Unit of the European Parliament has been asked to
reply to your request for information concerning the impact of the Brexit
negotiations on EEA nationals living in the UK and British citizens living
in EU Member States.
Please note that your message has been read attentively and its contents
duly noted.
Please note that, in accordance with Article 50 of the [1]Treaty on
European Union (TEU), any Member State which decides to withdraw from the
Union shall notify the European Council of its intention. This allows for
a two-year period for negotiations to be completed. According to Article
50(2) TEU, Parliament’s consent is required for a withdrawal agreement to
be concluded.
Please also note that the United Kingdom informed the EU of its intention
to leave the EU by letter of 29 March 2017.
The European Parliament adopted [2]a resolution on negotiations with the
United Kingdom following its notification that it intends to withdraw from
the European Union on 5 April 2017.
For more information, you may wish to consult the press release of the
European Parliament entitled [3]‘Red lines on Brexit negotiations’ and the
[4]summary of the resolution.
The European Council adopted its [5]guidelines for the Brexit negotiations
during its extraordinary meeting of 29 April 2017.
During a 17 May 2017 [6]plenary session debate on the conclusions of the
aforementioned European Council meeting, MEPs welcomed the unity with
regard to Brexit and also called for a reform of the EU to benefit all its
citizens, as you may note in this [7]press release of the European
Parliament.
Furthermore, on 22 May 2017, the Council authorised the opening of the
Article 50 negotiations with the UK and nominated the European Commission
as Union negotiator. Further details, including the European Council
guidelines, the negotiating directives, as well as the Commission’s
transparency policy for the negotiations, are available in this [8]press
release.
A negotiations [9]task-force was created by the European Commission, with
Michel Barnier [10]appointed by President Juncker in July 2016 as Chief
Negotiator in charge of the Preparation and Conduct of the Negotiations
with the United Kingdom. The Conference of Presidents of the European
Parliament [11]appointed Guy Verhofstadt as his counterpart in September
2016.
It should be noted that subjects of interest to citizens such as the
migration of EU citizens to the UK, or EU freedom of movement for UK
citizens, or any future arrangements on citizenship, may be settled during
the Article 50 negotiations. However, it is not possible at this time to
foresee what the result of these negotiations might be.
The European Parliamentary Research Service (EPRS) publication ‘[12]UK
withdrawal from the European Union: Legal and procedural issues’, as well
as the briefing [13]'Article 50 TEU: Withdrawal of a Member State from the
EU' and the study ‘[14]Brexit and the European Union: General
Institutional and Legal Considerations’, drawn up by the DG on Internal
Policies, may also be of interest to you.
If you wish to keep abreast of further developments please consult the
[15]top story on the [16]impact and consequences of Brexit on the EP
website.
We thank you for having contacted the European Parliament.
Yours sincerely,
Citizens' Enquiries Unit

Dear AskEP,
Thank you for your response related to my query.
I have read it through and my question has not been answered.
I have made the same request to the UK government which has yet to answer.
I have followed the Brexit process from the day 1 after the referendum. The current UK PM has continuously said regarding the Brexit negotiations that,i quote : No deal is better than a bad deal for UK.
Also she has always expressed the view that UK wouldn't be affraid to walk away from a bad Deal, same views shared by the UK brexit secretary,Mr Davis Davis.
So, this makes me understand that there is a real possibility for a No Deal Scenario.
Because of this No Deal Scenario possibility, i am requesting from your institutions to release any Contingency Plans regarding the Legal Status of EEA nationals in UK and the British Nationals in other EU countries. From your previous answer it's deductible that such plans don't exist. Because there are millions of citizens who can find themselves as illegals in a No Deal Scenario, i have to request you to confirm if there are any contingency plans in place or not.
Please release any Contingency Plans regarding EEA and British Nationals Legal status respectively in UK and EU in a No Deal scenario between UK and EU, if there is any.
Yours sincerely,
Skerdian Kerri
