Thank you for your reaction on my request for information. I can imagine that my request for all documents on EFF and EMFF would lead to too many documents. Therefore I'll focus my request a little bit more.
I'd like to receive all documents on 'deficiencies detected in the EFF and EMFF management
and control system in the Netherlands' between 2010 and now.
Please let me know if the scope of this request is reduced enough for you to make it workable.

We refer to your e-mail dated 12 July 2019 in which you make a request for
access to documents, registered on 15 July 2019 under reference number
Ares(2019)4548564. You request access to the communication between the
Netherlands and the European Commission on the European Fisheries Fund
(EFF) and the European Maritime and Fisheries Fund (EMFF) between 2014 and
the date of your request.
Following the letter from Ms. Tankink dated 19 July 2019, looking for your
agreement on a fair solution in order to reduce the scope of the request,
you replied on 25 July 2019 by asking for “all documents on 'deficiencies
detected in the EFF and EMFF management and control system in the
Netherlands' between 2010 and now. “. While we thank you for your
proposal to reduce the scope, we unfortunately need to come back to you on
the matter.
As indicated in our letter of 19 July, the regular correspondence between
the Commission services dealing with EFF and EMFF and the Netherlands
contains a large variety of documents and often voluminous annexes. The
documents need to be assessed individually before they can be shared in
order to respect privacy protection legislation. In a first survey of the
request as reduced per your suggestion, we have identified approximately
60 documents that could potentially be subject to your request. Documents
concerning the EFF are around 45 and about 1400 pages, the documents
concerning the EMFF are around 15 and about 200 pages.
Considering the particular type of documents this concerns, we consider
that the analysis of these documents cannot be expected to be completed
within the normal time limits set out in Article 7 of Regulation
1049/2001. The specific and individual examination of each document proves
to be particularly heavy, not only due the volume of the documents
requested, but more particularly as very considerable part of these
documents contain commercially sensitive data and/or personal data which
will need to be assessed in detail and to be redacted. This would involve
an inappropriate administrative burden which we consider to be
disproportionate for a small service like DG MARE.
Furthermore, for any documents that are not issued by the Commission,
consultation of the third parties concerned is required in accordance with
Article 4(4) and 4(5) of Regulation 1049/2001. In that case, it means that
the Commission will have to ask the Netherlands their agreement to
disclose the documents originating from them.
Therefore, with a view to finding a fair solution and safeguarding the
interests of good administration, looking at the maximum of what can be
reasonably delivered, and considering that your original request concerned
the period from 2014 onward, we propose to narrow down the scope of your
request and to answer to you only on the communication concerning the
EMFF.
In order to enable us to respect the time limits of Regulation 1049/2001,
we would ask you for a swift reply to our invitation to a fair solution as
mentioned above, within five working days at the latest:
