Emails an Journalisten mit "Ausdrücken der Unzufriedenheit"

Guten Tag, Europäische Agentur für die operative Zusammenarbeit an den Außengrenzen,

Auf Basis der Informationsfreiheit in den EU-Verträgen, verbrieft in Verordnung 1049/2001, beantrage ich Dokumente, welche folgende Informationen enthalten:

Laut https://twitter.com/frederikrichter/stat... wurden vom Emailaccount [email address] Emails an Journalisten geschickt, in denen offenbar die Berichterstattung über Frontex kritisiert wurde.

Ich hätte gerne eine Liste dieser Emails mit solchen Korrekturaufforderungen, Beschwerden über Berichterstattung oder ähnlichen Anliegen sowie alle internen Unterlagen (Memos, Briefe, Entwürfe, Notizen, Protokolle, Emails) darüber, wie diese Emails entstanden, entworfen oder verschickt und ausgewertet wurden.

Diese Anfrage erstreckt sich auch auf solche Informationen, die nach den EU-Archivierungsregeln nicht als "wichtig" oder archivierungspflichtig angesehen werden, also insbesondere auch Emails, die sich noch auf dem Postfach des accounts [email address] befinden.

We will start processing your application after providing you with acknowledgement of receipt of the above mentioned documents and will reply within 15 working days.

Please be informed that:
• The person responsible for controlling your personal data (data controller) is the Head of the Transparency Office; • Personal data is collected for the exclusive purpose of assessing the nationality/proxy of the applicant and, if applicable, the seat of the entity represented by the applicant; • Only relevant staff members have access to your data; • Your data is deleted at the latest when you receive the final reply. Processing your application takes a maximum of 15 or 30 working days depending on the number/size of the document(s) applied for; • You are entitled to access and rectify your data during the processing of your application; • During any steps of the process, you have the right to have recourse to the European Data Protection Supervisor.

Nach Artikel 41 Absatz 4 der Charta der Grundrechte der Europäischen Union (2012/C 326/02) kann sich jede Person in einer der Sprachen der Verträge an die Organe der Union wenden und muss eine Antwort in derselben Sprache erhalten.

Meine Anfrage an Sie war auf deutsch gestellt, bitte antworten Sie dann auch gemäß Artikel 41 Absatz 4 der Grundrechtecharta in dieser Sprache.

Meinen Antrag auf Zugang zu Dokumenten haben Sie bereits am 14. August erhalten, ich werde ihn deshalb selbstverständlich nicht noch einmal an Sie auf einem anderen Wege zusenden.

Nach Artikel 7 Absatz 1 Satz 1 der Verordnung 1049/2001 sind Sie verpflichtet, meinen Antrag auf Zugang zu Dokumenten unverzüglich zu bearbeiten. Ich fordere Sie daher unmissverständlich auf, mir die Empfangsbescheinigung nach Artikel 7 Absatz 1 Satz 2 der Verordnung 1049/2001 zuzusenden.

Ich weise Sie auf die Konsequenzen einer verspäteten oder unterlassenen Bearbeitung meines Erstantrages hin.

Hallo Frontex,

die Anforderung nach einem "Berechtiungsnachweis" ist mit den Vorgaben der Verordnung 1049/2001 unvereinbar.

Sofern Sie ihre Verweigerung der Registrierung meiner Anfrage auf die "Management Board Decision 25/2016" beziehen:

Nach Artikel 3 Absatz 2 der Management Board Decision werden von Frontex Anträge auf Dokumentenzugang auf einer fallweisen Basis bearbeitet, wenn die Anfragenden nicht ihren Wohnsitz oder ihre Staatsbürgerschaft in einem Mitgliedstaat der Europäischen Union haben.

Diese Regelung ist, wenn man sie korrekt anwendet, geeignet, die (meiner Meinung nach rechtswidrige) Forderung nach einem Nachweis wie in Artikel 5 Absatz 3 der Management Board Decision auszuhebeln, weil der Dokumentenzugang nach den Regeln von Artikel 3 Absatz 2 nicht mehr ausschließlich an Unionsbürgerschaft oder Residenz gekoppelt wird. Wenn es Ihnen hilft, stelle ich dazu gerne einen hilfsweise Antrag, um eine solche Fallentscheidung nach Artikel 3 Absatz 2 der Management Board Decision herbeizuführen.

Das Ombudsman-Büro der Europäischen Union hat in der Entscheidung 682/2014/JF festgehalten, dass bereits die Anforderung der Übermittlung einer Postadresse bei der Registrierung einer Anfrage zum Zugang auf Dokumente nach der Verordnung 1049/2001 einen Verstoß gegen gute Verwaltungspraxis ("maladministration") darstellt. Diese und die darüber hinausgehenden Anforderungen der Frontex Management Board Decision sind demnach ebenfalls unverhältnismäßig und mit Artikel 15 Absatz 1 der Verordnung 1049/2001 unvereinbar.

Bitte bestätigen Sie daher zeitnah, dass Sie meine Anfrage registriert haben.

Dear Mr Schindler,

As you base your refusal to provide an ID to enable Frontex to establish eligibility on Article 3(2) of Management Board Decision 25/2016 of 21 September 2016 (MB Decision), which regulates – in English - practical arrangements regarding public access to the documents held by Frontex, this reply also uses this working language of the Agency. In your attempt to juxtapost Article 3(2) and Article 5(2) of the MB Decision, you did not consider the different scopes of these Articles. Article 3(2) of the MB Decisions pertains to the possible extension of the scope of beneficiaries and mirrors Article 2(2) of Regulation (EC) 1049/2001. Article 5(3) of the MB Decision lays down the procedure enabling Frontex to establish eligibility of said beneficiaries.

With reference to your argument regarding Article 15(1) Regulation (EC) 1049/2001, decisions of the Frontex Management Board cannot supersede obligations laid down in EU primary or secondary legislation such as Regulation (EC) No 1049/2001 or the current European Border and Coast Guard Regulation and Frontex offers several alternatives for establishing eligibility in order to facilitate the exercise of the right of access as indicated on our website, the link to which was made available to you on 19 August 2019: https://frontex.europa.eu/de/transparenz....

In regard to your reference to the European Ombudsman Decision in case 682/2014/JF, please be informed that decisions of the European Ombudsman are not legally binding erga omnes. Nevertheless, this Decision refers in its core to an institution’s demand of an applicant’s address for correspondence. Even the complainant noted that establishing her identity with certainty would prerequisite the provision a copy of her passport.

Kindly provide your proof of eligibility, which could constitute any copy of an official document/statement of a EU Member State authority indicating - solely - your name and EU citizenship/domicile by 28 August, 17:00 Warsaw time to enable us to process your application as otherwise your case will be closed.
