Ethics materials

Ihre Anfrage war teilweise erfolgreich.

Margarida da Silva

Dear Human Resources and Security,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- dedicated training, presentations and information materials that were prepared to raise outgoing and incoming cabinet members’ awareness of their ethical obligations,
- The most up to date Practical guide to ethics and conduct,
- any statistics or analysis relevant to the implementation of Staff Regulations Article 16 and Article 40. I am particularly interested in finding the number of requests that were rejected.

Yours faithfully,

Margarida da Silva

Dear Madam,

Thank you for your mail of 17 July 2020. We hereby acknowledge receipt of your application for access to documents, which was registered today under reference number GESTDEM 2020/4871.

In accordance with Regulation (EC) No 1049/2001 regarding public access to European Parliament, Council and Commission documents, your application will be handled within 15 working days. The time limit will expire on 07/09/2020. In case this time limit needs to be extended, you will be informed in due course.

You have lodged your application via a private third-party website, which has no link with any institution of the European Union. Therefore, the European Commission cannot be held accountable for any technical issues or problems linked to the use of this system.

In that case, the Commission will send all future electronic correspondence addressed to you only to that private address, and it will use only that private address to reply to your request. You should still remain responsible to inform the private third-party website about this change of how you wish to communicate with, and receive a reply from, the Commission.

Dear DI GIOVANNI Samuel(HR),

Thank you for the email. While I understand that there might be atenuating circumstances, this response is already long overdue. My request was lodged 17 July, that is almost two months ago.

It took DG HR exactly one month to even aknowledge the request.

As my request relates only to ethics material, it does even not require consultations with third parties, answering it should be fairly straightforward. I cannot understand why it takes this long to answer.

Yours sincerely,

Margarida da Silva

Dear DI GIOVANNI Samuel(HR) and ENJOLRAS Dominique ,

Thank you very much for your reply and for being so helpful. I really appreciate that you have identified related documents that could be of interest to me and for extracting the statistic relating to Article 16 and 40.

I would like to lodge a follow-up request. I am requesting documents which contain the following information:
- The reasoning or justification for the 3 unfavourable decisions taken in 2019 relating to the implementation of Article 16 of the Staff Regulations
- The reasoning or justification for the 3 unfavourable decisions taken in 2019 relating to the implementation of Article 12b in combination with 40 of the Staff Regulations

Please note that I am not interested in personal data - feel free to redact that information. I am merely interested in knowing why those requests were not authorised.

Yours sincerely,

Margarida da Silva
