EU cyber sanctions - Asset Freezes III
Dear Financial Stability, Financial Services and Capital Markets Union,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting information related to Article 8(1)(a) of Council Regulation (EU) 2019/796:
(1) The number of assets frozen by the member states, pertaining to the 8 natural persons and 4 legal persons, entities and bodies as listed in Council Implementing Regulation (EU) 2020/1125, 2020/1536, and 2020/1744
(2) The combined approximate value of the assets frozen by the member states, pertaining to the 8 natural persons and 4 legal persons, entities and bodies as listed in Council Implementing Regulation (EU) 2020/1125, 2020/1536, and 2020/1744
Note: This is not a request for personal data as defined under Article 3 of Regulation (EU) 2018/1725, nor is a request to disclose specific relevant data pursuant to Article 8(2) of Regulation (EU) 2019/796. This access request is only aimed at a broad anonymized summary of the data provided to the Commission, for the academic purpose of evaluating the rudimental effectiveness of Council Decision (CFSP) 2019/797. Access to this broad data summary is likely in the public interest and it strongly aligns with Article 2 of Regulation (EC) No 1049/2001.

I am filing the following confirmatory application with regards to my access to documents request 'EU cyber sanctions - Asset Freezes III'.
GestDem 2021/6015 of October 13, 2021, is one of three other FOI requests (GestDem No 2020/6931 of November 13, 2020, and GestDem 2021/3472 of May 27, 2021) regarding the exact same information, i.e. number of assets frozen and the combined value of the assets frozen.
As a response to GestDem No 2020/6931 of November 13, 2020, the Commission explained that it "has not received information referred to in Article 8(1)(a), directly from any natural or legal person, entity or body that is required to apply the freezing measure. Nor does it have sufficient information from Member States to provide a more or less reliable overall value of the funds and economic resources frozen in the EU pursuant to Regulation (EU) 2019/796. Given that the Commission holds no documents corresponding to the description given in your application, the Commission is not in a position to fulfil your request."

Approximately six months later I filed GestDem 2021/3472 of May 27, 2021, in the hope that maybe the Commission might have received new information from the member states. In its reply, the Commission indeed does note that it "has received certain data from the competent authorities of the Member
States but has not received any documents sent by natural and legal persons, entities and
bodies pursuant to Article 8." It subsequently denied access to the information citing the protection of the public interest, public security, the protection of personal data, and the protection of privacy and integrity of the individual. (See: https://www.asktheeu.org/en/request/9572..., p. 2)
GestDem 2021/6015 of October 13, 2021, was filed without any reference to GestDem No 2020/6931 or GestDem 2021/3472. This was an oversight on my part. Curiously though, the Commission merely responded that "We regret to inform you that the Commission does not hold any documents that would correspond to the description given in your application," which stands in direct contradiction to GestDem 2021/3472 of May 27, 2021. At this point it feels a bit like running in cycles which is the reason for this complaint. I am merely seeking two numbers: the number of assets frozen and the combined approximate value of the assets frozen. Nothing else. Just two plain numbers or even a range in the latter case. The Commission should be able to provide these two basic numbers to the public, and it should be aware of both numbers as stipulated in Article 8(1) and Article 12(1) of Regulation (EU) 2019/796. In my reading, these two numbers should also not be covered by Article 8(3) of the same Regulation, as the data is anonymize to such a significant degree that it does not include specific information as outlined in Article 8(1) and (2).
After more than a year of last imposing EU cyber sanctions under Regulation (EU) 2019/796, the Commission should be able to provide the public with a rudimental sense as to whether any financial assets were frozen as set out in Article 3(1).
