Under the right of access to documents in the EU Treaties, as developed in Regulation 1049/2001, I hereby request access to the following documents in your possession related to the European Arrest Warrant (EAW):

i. Documents containing case numbers and/or courts assigned in the issuing Member State to proceedings related to EAW’s issued by Poland, Lithuania, Spain and Romania from 2014 to present;
ii. Documents containing case numbers and/or courts assigned in the executing Member State to proceedings related to EAW’s issued by Poland, Lithuania, Spain and Romania from 2014 to present;
iii. Documents containing lists or summaries sufficient to identify the information requested in sub-paragraph (i)-(ii) above;
iv. Documents establishing any policies or procedures that EUROJUST has in place to monitor EAW cases in issuing Member States after the execution of an EAW, including compliance with any bilateral agreements made between the issuing and executing states.

extended, you will be informed in due course.

Regarding your request for access to documents containing case numbers
and/or courts assigned in the issuing and executing Member State to
proceedings related to EAW’s issued by Poland, Lithuania, Spain and
Romania from 2014 to present (subparagraphs i and ii), as well as for
access to documents containing lists or summaries sufficient to identify
the information requested in subparagraphs i and ii (subparagraph iii), we
regret to inform you that your application cannot be granted, as
disclosure is prevented by exceptions to the right of access laid down in
Article 4 of [1]Eurojust Decision to adopt rules regarding public access
to Eurojust documents of 13/07/2004.

 

We must refuse access to the requested documents as their disclosure would
undermine the protection of the public interest as regards fulfilment of
Eurojust’s tasks in reinforcing the fight against serious crime and as
regards national investigations and prosecutions in which Eurojust
assists. Therefore, the exceptions laid down in Article 4(1) (a) of
Eurojust Access to Documents Decision apply to these documents.

 

Finally, concerning your request for access to documents establishing any
policies or procedures in place at Eurojust to monitor EAW cases in
issuing Member States after the execution of an EAW, including compliance
with any bilateral agreements made between the issuing and executing
states, please note that Eurojust does not hold such documents. However,
as mentioned below you may find useful information for your research in
the Final Report of the Eurojust’s seminar “The European Arrest Warrant:
Which way forward?”, which you can find on the Eurojust website [2]here.

 

In accordance with Article 7(4) of the Eurojust Access to Documents
Decision, you are entitled to make a confirmatory application requesting
Eurojust to reconsider its position. Such a confirmatory application has
