I am writing to request an internal review of Employment, Social Affairs and Inclusion (EMPL)'s handling of my FOI request 'Expert Group on De-Instititionalisation (DI)'.
The reply I received was not satisfactory.
As concerns the information you sent:
- The report is publicly available
- The Minutes of the Expert Group – all names blackened. Was there only one meeting?
- The internal note from DG EMPL is not dated, registered or signed. And I did not get the initial note of the Cabinet dated 20/2/2009.
I hereby make a confirmatory appeal, and request access to the above mentioned note and any other documents available related to the setting up of the Ad Hoc Expert Group and the Expert Group on De-Institutionalisation aka european expert group on transition from institutional to community based care (related to, inter alia: mandate, selection of experts, financing, selection of chairperson, secretariat).
In view of transparency and accountability I consider that the public at large has an interest to know how policy making in the EU is taking shape.
In his video message of 26 October 2012, Commissioner Lazlo stated that the Commission collaborates with the european expert group on transition from institutional to community based care group (aka European Expert Group on De-Institutionalisation).

I have not been able to find these two Expert Groups in the Register of Expert Groups.

I am writing to request an internal review of Employment, Social Affairs and Inclusion (EMPL)'s handling of my FOI request 'Expert Group on De-Instititionalisation (DI)'.
I have to inform you that I find the response of DG EMPL not satisfactory.
I asked the following questions:
- all documents, correspondence, logs related to the establishment of the Ad Hoc Expert Group on the Transition from Institutional to Community-based Care
- all documents, correspondence, logs related to the establishment of the European Expert Group on De-institutionalisation.
The documents I received concern only the first group: the Ad Hoc Expert Group.
No documents were provided related to the European Expert Group on De-institutionalisation.
Also, as far as I am aware there should be transparency on the members of such groups.
I also consider it not done that all names are blackened, including EU officials.
It was also not explained why these groups are not registered on the Commission's register on Expert Groups and other similar entities.
This seems to be in conflict with the "COMMUNICATION FROM THE PRESIDENT TO THE COMMISSION
FRAMEWORK FOR COMMISSION EXPERT GROUPS", dated 10/11/201, which states:
"HORIZONTAL RULES AND PUBLIC REGISTER
In October 2005 the Commission launched an on-line Register of expert groups5, providing access to valuable information on key elements of individual expert groups, including their mission, tasks and policy areas concerned. Over the years, the Commission has been focusing on improving the quality and reliability of data included in the Register, notably through regular updates. The Commission has also enhanced transparency by gradually publishing the
names of members of expert groups in the Register; this exercise was completed in January 2009."
Therefore I still look forward to the requested documents, and an explanation why these groups are not part of the Register.

I refer to your message copied below, by which you request an internal review of the reply given by DG EMPL following your initial application of access to documents registered under the above-mentioned number.
In its initial reply, DG EMPL provided you with a number of documents from which the names of Commission staff and experts' names had been removed.
Following your confirmatory application addressed to the Secretariat General, we have now initiated the process of consulting the experts concerned, pursuant to Data Protection Regulation 45/2001, on the possible disclosure of their names. We also intend (subject to our Legal Service approval) to disclose the names of Commission staff, as we have not identified any specific risks to such disclosure.
We are also verifying whether there could be any other documents falling under the scope of your request.
Please be informed that, due to the need to conduct these verifications and to consult the external experts concerned, followed by the obligatory internal consultations (of our legal Service, followed by approval by our Head of Unit, Director, Deputy Secretary General and Secretary General, given that the decision on access will be taken by the Secretary General on behalf of the European Commission), it may still take a few weeks before you will receive a final decision.
Please know however that we are doing our utmost to provide you with a confirmatory reply within the shortest possible deadlines.
