Dear Regional Policy (REGIO),

Thank you for your response, in which you ask me for a postal address, which you state is "required" for registering and handling my request in line with the "procedural requirements".

According to Regulation 1049/2001, the only things which may be "required" of an applicant in order for a request to be registered are found in Article 6.1, which includes an exhaustive list: applications must be made in "any written form", in one of the official languages, and in a "sufficiently precise manner to enable the institution to identify the document".

At no point does the Regulation mention that the requester must provide their postal address before the request can even be registered by the services. Indeed, Article 6.1 goes on to emphasis that "The applicant is not obliged to state reasons for the application", which is consistent with the fundamental nature of the right of access to documents.

Furthermore, the Regulation states that requests for access to documents should be handled "promptly" and at Article 15 there is an explicit reference to the need to "develop good administrative practices in order to facilitate the exercise of the right of access guaranteed by this Regulation." The refusal to register a request if the citizen involved does not provide a postal address is contrary to the principles of good administration and also serves to delay the processing of requests sent to the institutions, which constitutes an unreasonable and disproportionate impediment to the exercise of the fundamental right of access to EU documents.

Finally, in your response you have not indicated which "procedural requirements" you are referring to, which leaves me little certainty as to which procedural steps I now need to follow in order to exercise my right of access to documents. I am therefore requesting a copy of these requirements in order to know where I stand legally.

I would like this to be considered as a confirmatory application against your refusal to process my request without a postal address.

At the same time, since I am interested in obtaining the documents requested and have already been waiting for a response to my request since March 31th, please find Access Info's postal address below, as I do not consider it reasonable or appropriate to have to provide my personal details to the European Commission before you will process a request to exercise my fundamental rights:

Les recuerdo que el plazo para la respuesta a mi petición GESTDEM 201A/2402, que ya había sido prorrogado con 15 días extra, expiró hace más de un mes (24 días hábiles de retraso, exactamente).

De hecho, realicé esta solicitud de información no el pasado 6 de mayo en el portal web Asktheeu.org, sino el pasado 9 de marzo de manera privada a la portavocía del comisario Hahn, es decir, hace cuatro meses y tres semanas. No consigo entender las razones de este largo retraso.

En consecuencia, solicito que se realice una revisión interna del tratamiento de mi solicitud GESTDEM 201A/2402 por parte de su departamento.

Estimado Sr Jarreta,

Adjunto encontrará una tabla que recoge la totalidad de los proyectos del Eje 2 "MEDIO AMBIENTE, ENTORNO NATURAL Y RECURSOS HÍDRICOS" , Medida 2 "Gestión integral de los residuos urbanos y de los residuos industriales tratados (FEDER)" única medida en la que tienen cabida este tipo de proyectos.

En primer lugar aparecen los correspondientes a la CA

y después los de ayuntamientos (entre éstos no está el Ayto. de Madrid).

Todo ello, FEDER, referido al período anterior, ya que en el actual (2007-2013) no hay nada sobre esta materia.

Estimado REGIO G2 SPAIN,

Muchas gracias por el envío del documento. Debo señalar, sin embargo, que me ha sorprendido mucho la ausencia en el mismo de proyectos gestionados por el Ayuntamiento de Madrid o por empresas concesionarias de servicios municipales en la ciudad de Madrid.

Existen, por ejemplo, expedientes como el de 'INSTALACIÓN DE DESGASIFICACIÓN Y APROVECHAMIENTO DE BIOGÁS, SELLADO Y RECUPERACIÓN PAISAJÍSTICA DEL VERTEDERO DE VALDEMINGÓMEZ' (2001-ES-16-C-PE-012), procedente del Fondo de Cohesión 2000-2006, cuyo coste total ha sido financiado en su mayoría por fondos de la Unión Europea.

Solicité documentos que contengan cualquier tipo de subvención europea sobre gestión y tratamiento de residuos concedida al Ayuntamiento de Madrid, la Comunidad de Madrid y/o sus empresas concesionarias.

¿Por qué el Parque Tecnológico de Valdemingómez no aparece en vuestro documento? ¿Por qué el Ayuntamiento de Madrid no aparece en vuestro documento? ¿Por que las empresas concesionarias no aparecen en vuestro documento?

Estimado REGIO G2 SPAIN,

Sigo a la espera de parte de los datos que les solicité en mayo (documentos que contengan información relativa a subvenciones europeas concedidas al Ayuntamiento de Madrid y a sus empresas concesionarias en materia de tratamiento y gestión de residuos desde 2001 hasta hoy).

Me gustaría también que me aclararan por qué en su documento de respuesta del pasado 8 de octubre omitieron los datos del Ayuntamiento de Madrid y de las empresas concesionarias.
