According to the Council document "Fight against terrorism: follow-up to the statement of 12 February by the Members of the European Council and to the Riga Joint Statement of 29
January by the Ministers of Justice and Home Affairs of the EU", the Commission is charged with ensuring that the "Forum with the Internet service providers community" contributes to the future work of the Europol Internet Referral Unit.

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- information on the Unit responsible for the coordination of the Forum

I am writing to request an internal review of Communications Networks, Content and Technology's handling of my FOI request 'Forum with the Internet service providers community'.

In the reply to my request (ref. home.d.1(2015)2166410), it is stated that there are no documents in relation to the "Forum with the Internet service providers community". However, regarding the tasks and objectives of that forum, there is a reference to point 2.6 of the Commission's Communication "Preventing Radicalisation to terrorism and Violent Extremism" (COM(2013)941 final of 15 January 2014).

Since this document was finalised one and a half years ago, I would like confirmation that there are no further documents or communications between the private sector and the Commission following the announcement to "set up a forum with key players in the industry".

Furthermore, I would like to request access to documents and communications between the Commission and "community groups" and "citizens" mentioned in that section, or a confirmation that no such documents exist.

Lastly, since the letter mentions that the "work of the forum has only started", I would like to make a confirmatory request to access documents regarding plans for setting up the Forum.

However, Article 7(3) of Regulation (EC) No 1049/2001 states that, in case of an exceptional case, the time limit can be extended if "detailed reasons are given".

In fact, at confirmatory level a fresh assessment of each case is carried out by the Secretariat-General. For this fresh assessment the Secretariat General asks the DGs concerned to provide the elements that are necessary for completing its assessment. The draft reply is then submitted to the Legal Service for agreement or possible comments. These consultations are still on-going in your file. We will reply to you as soon as these consultations and, subsequently, the formal approval by the Secretary-General are finalised.

We reiterate our sincere apologies for the delay. Please be assured however that we are doing the utmost to provide you with a reply within the shortest possible time-span.

I am hereby submitting a confirmatory application in accordance with Article 7(2) if Regulation 1049/2001 with regard to the following points:

1) In its first response of 11 May, the Commission stated that no documents existed as the Forum was not set up at the time of our first request. However, the meeting report (7 May 2015) transmitted to us quotes the European Agenda on Security, stating that this Forum was “building upon preparatory meetings organised in 2014”.

We would therefore like to ask the Commission to verify the existence of documents related to these preparatory meetings.

2) With regard to the documents mentioned under 3 a) of its response (Ares (2015) 3219914 (GestDem 2015-3658)):

- The Commission argues that it cannot disclose these documents (note of 10 June 2015 and concept note) to remain "free from external pressure". However, the Forum discusses the contents of these documents with the industry sector, and hence with external stakeholders. Can the Commission review the disclosure of the documents or, failing this, transmit a set of criteria that defines which types of stakeholders receive invitations to the Forum and hence access to the discussions?

- We understand that the tackling of terrorist propaganda online is a delicate matter. However, since online communications are affected, it is very likely that some policy options discussed by the Forum have a broader impact on the fundamental right to freedom of expression. We would therefore like to make a confirmatory request since we believe that human rights experts should be consulted when it comes to "restricting access" to communications, as discussed by the Forum.

3) In its response (Ares (2015) 3219914 (GestDem 2015-3658)), the Commission failed to provide a list of the documents it identified in relation to the Internet Forum. We would therefore like to ask the Commission to provide a list of documents which have a link with the IT Forum.
